ORDINANCE NO. 77-45
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, CONCERNING THE
FINAL DEVELOPMENT PLAN OF JAMES H. GREGORY,
FOR THE DEVELOPMENT LOCATED SOUTH OF SEA BLUFF
DRIVE AT CANYON DRIVE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa hereby finds and
declares that the developer, James H. Gregory, has heretofore processed a
Preliminary Development Plan, being ZE-77-117A, for the planned development
located in a PDR -MD zone south of Sea Bluff Drive at Canyon Drive, Costa
Mesa, California; that said Preliminary Development Plan has heretofore been
processed and approved pursuant to Section 13-247 et seq., Costa Mesa
Municipal Code.
The City Council of the City of Costa Mesa further finds that said
developer has now submitted a Final Development Plan for said development
which has been found by the Costa Mesa Planning Commission, to substantially
comply with said Preliminary Development Plan, and to substantially comply
with the intent, standards, and procedures of said ordinance, the California
Environmental Quality Act, Chapters 3 and 4 of Title 7 of the California
Government Code relating to Local Planning, and Articles 2, 3, and 4, Chapter
III, Title 13 of the Costa Mesa Municipal Code to the extent applicable,
which findings are approved and adopted herein; that no major change or
addition to said Final Development Plan has occurred subsequent to its
approval by the Costa Mesa Planning Commission; finally, the City Council of
the City of Costa Mesa finds that this matter is being adopted by ordinance,
rather than resolution, to comply with applicable laws and shall not require
inclusion in the Costa Mesa Muncipal Code since it concerns one parcel of
land only and may be indexed on the City Clerk's Miscellaneous Uncodified
Ordinance list.
Section 2. The Final Development Plan of James H. Gregory for the planned
development, being No. ZE-77-117A, located in a PDR -MD zone south of Sea Bluff
Drive at Canyon Drive, Costa Mesa, is hereby approved.
SECTION 3. This ordinance shall take effect and be in full force
thirty (30) days from and after its passage, and prior to the expiration
of fifteen (15) days from the passage thereof, shall be published once
in the Orange Coast Daily Pilot, a newspaper of general circulation,
printed and published in the City of Costa Mesa, together with the names
of the members of the City Council voting for and against the same.
PASSED AND ADOPTED this 6th day of September, 1977.

I, EILEEN P. PHINNEY, City Clerk and exofficio Clerk of the City
Council of the City of Costa Mesa, hereby certify that the above and
foregoing Ordinance No. 77-45 was introduced and considered section by
section at a regular meeting of said City Council held on the 15th day
of August, 1977, and thereafter passed and adopted as a whole at a
regular meeting of said City Council held on the 6th day of September,
1977, by the following roll call vote:

Smallwood
NOES: Council Members: None
ABSENT: Council Members: Hammett
