HomeMy WebLinkAbout75-19 Amending Code Regarding Property Development Standards1ORDINANCE NO. q s- y g AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING TITLE 13, ARTICLE 3 14, (C-1 LOCAL BUSINESS DISTRICT), SECTION 13-208 (PROPERTY DEVELOPMENT STANDARDS). 4 5 THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY 6 ORDAIN AS FOLLOWS.: 7 SECTION 1: The City Council of the City of Costa Mesa 8hereby finds and declares that the pre-existing property developm 9 standards were not consistant with the city's overall attempts to '10l promote the orderly planned use of land resources. 11 The City Council further finds and declares that to provide 12 for consistant application of property development standards 13 throughout the city requires that the local business district as 14 set forth in Costa Mesa Municipal Code Section 13-76 and Article 14, 15 commencing with Section 13-207 requires that adoption and applicatio. 16 of such standards as hereinafter set forth. . 17 The City Council of the City of Costa Mesa further finds 18 and declares that the health, safety and welfare of the public re - 19 quire said property development standards in said district. 20 Accordingly, the following section is added, by 21 amendment to Title 13, Article 14, being Section 13-208 which shall 22 read as follows: 23 I SECTION 2: "Sec 13-208 PROPERTY DEVELOPMENT STANDARDS 24 1) UNDERGROUND UTILITIES: 25 For all new construction, all utilities shall be 26 installed underground on the building site in 27 accordance with the serving utility's rules, 28 regulations, and tariffs on file with the 29 California Public Utilities Commission. 30 31 The Planning Commission may waive the required 32 undergrounding whenever such installation is -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 2) 3) 4) 5) determined by the Planning Commission to be not practically feasible. Provided, however, that all required termination facilities on the structure and conduit, at least to the outer wall, at a point designated by the serving utility, shall be furnished and installed to facilitate future connection to an underground system. USES UNDER ROOF: All permitted uses shall be conducted under roof. OUTDOOR STORAGE: All outdoor storage is prohibited unless approved as a conditional use according to procedures prescribedelsewhere in this ordinance. LOT SIZE: A. Minimum Lot area 12,000 square feet B. Minimum Lot Width - 67 feet Any legal lot for which a deed was on record in the office of the County Recorder of Orange County on the date of adoption of this Ordinance may be used as a building site. LANDSCAPING: All required setbacks, abutting a public right of way shall be landscaped, (except for walks and driveways which bisect or encroach upon the required landscape area). There shall be a minimum of ten foot setback from the proposed right of way as shown on the Master Plan of Highwa (A) A landscape plan (including planting material specifications) shall be submitted to the Planning Department. Approval of landscape plans shall be under the jurisdiction of the Planning Department. -2- EI 9I 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 (B) All required landscaping shall be separated from paved areas by six (6) inch high Portland cement concrete curbing and shall be provided with automatic sprinkler facilities, which shall be maintained in an operative condition. (C) One tree (15 gallon minimum size) shall be installed per 200 square feet of landscaped area. (D) Parking lots shall be broken up with planters. These planters shall total to at least ten percent (10%) of the paved areas. The minimum size planter shall be twenty five (25) square feet. No credit will be allowed for this re- quirement for the landscaping of the setback landscape planter. (E) Every site on which landscaping is required, according to this ordinance, shall be land- scaped according to plans approved as specifies herein and maintained hereafter in a sightly and well -kept condition, irrigated periodically, trimmed, cultivated, vegetation replaced as needed and cuttings and leaf droppings removed as often as necessary to insure a neat and orderly appearance. SECTION 3:. This ordinance shall take effect and be in full force and effecty thirty (30) days from and after its passage and before the expiration of fifteen (15) days after its passage, shall be published once in the Orange Coast Daily Pilot, a newspape of general circulation printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against same.
