AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, AMENDING TITLE 13 OF THE
COSTA MESA MUNICIPAL CODE REGARDING RESIDENTIAL
PARKING AND OPEN SPACE REQUIREMENTS.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1: The City Council of the City of Costa Mesa finds
and declares as follows:
WHEREAS, the current residential parking standards have been
in place since 1972; and
WHEREAS, recent surveys have indicated that automobile
ownership and guest parking requirements exceed the parking
provided for by the current residential parking standards; and
WHEREAS, an increase in the parking requirement could cause a
decrease in unit size unless the open space standard is also
decreased commensurate with the parking increase;
ACCORDINGLY, the City Council of the City of Costa Mesa hereby
amends Title 13 of the Costa Mesa Municipal Code as follows:
SECTION 2:
Subsection 1 of Section 13-140 of the Costa Mesa Municipal
Code is hereby amended as follows:
1-1. A minimum of forty (40) per cent of the total parcel area
shall be reserved as open space. Required open space may be
reduced to thirty-six (36) per cent of the total parcel area
if: 1) at least ten (10) per cent of the driveway and
required open parking is paved in a decorative nature and 2)
the parking is provided in accordance with this ordinance
(No.92-1) or a subsequent amendment."
SECTION 3:
Subsection 8 is hereby added to Section 13-142 of the Costa
Mesa Municipal Code to read as follows:
"8. Each unit shall be provided with 200 cubic feet of
securable storage exterior to the unit. If this storage is
provided within the garage or carport it shall be located
under the direction of the Planning Division so as to not
obstruct the required clear dimensions of the covered parking
space (per the City of Costa Mesa Parking Design Standards) up
to a height of 4 feet above the finished surface level of the
parking stall."
SECTION 4:
Subparagraph 2 of Paragraph (a) Subsection 4 of Section 13-252
of the Costa Mesa Municipal Code is hereby amended as follows:
"The required open space shall be land areas that are not
occupied by buildings, structures, parking areas, driveways,
streets or alleys. Landscaped roof areas or decks may not be
calculated as part of the required open space. Said open
space shall be devoted to landscaping, preservation of natural
features, patios, and recreational areas and facilities.
Except that required open space may be reduced ten (10) per
cent if: 1) at least ten (10) per cent of the driveway and
required open parking is paved in a decorative nature and 2)
the parking is provided in accordance with this Ordinance
(No. 92-1) or a subsequent amendment. At least fifty (50) per
cent of the required open space shall be designed for the
common use of the residents of the planned development, except
for small -lot, single-family development."
SECTION 5•
Subsection (a) of Section 13-545 of the Costa Mesa Municipal
Code is hereby amended as follow:
"(a) At the time of the erection of any building and/or
structure or at the time any such building or structure is
enlarged or increased by adding additional bedrooms there
shall be provided the following minimum off-street parking
spaces with adequate provisions for safe ingress and egress
and said parking spaces shall thereafter be maintained in
connection with such building or structure and use of land."
SECTION 6•
Paragraph (2) of Subsection (a) of Section 13-545 of the Costa
Mesa Municipal Code is hereby amended as follows:
"(2) R2, R3, R4, PDR -LD, PDR -MD, PDR -HD, PDR -UC and
residential components of developments in the PDC and PDI
zones. Required parking shall be per the following table;
except that detached dwelling units on individual lots in the
PDR -LD, PDR -MD, PDR -HD, and PDR -UC zones served by a public or
private street with a roadway width (distance measured between
opposite curb faces) of thirty-six (36) feet or more, shall
provide parking according to section 13-545 (a)(1)."
Paragraph (3) of Subsection (a) of Section 13-545 of the Costa
Mesa Municipal Code is hereby deleted.
SECTION 8•
Subsection (b) of Section 13-545 of the Costa Mesa Municipal
Code is hereby deleted.
SECTION 9:
Subsection (e) of Section 13-828 of the Costa Mesa Municipal
Code is hereby amended by adding Paragraph (3) to read as follows:

If covered parking for apartments is provided in a parking
structure and there is more than one parking apace in any parking
structure, then there shall be no solid walls constructed to
separate individual parking spaces.
(2)
Open parking spaces required by this Section shall be distributed
throughout the project at convenient locations and shall be
screened from view from any public right-of-way.
(3)
Individual driveways of at least 19 feet in length leading to two -
car garages shall each account for no more than one (1) of the
required open parking spaces. The garages shall be furnished with
automatic garage door openers and roll up doors as appropriate
under the direction of the Planning Division.
(4)
Open parking can be reduced by .25 apace per unit for one bedroom
and larger unite if the covered parking is provided within either a
carport or a parking structure. For purposes of this section, a
parking structure shall be defined as: a structure designed and
constructed to provide covered automobile parking where parking
spaces are located in a common area with no walls or other physical
separations between spaces.
(5)
Guest parking shall be clearly marked and permanently maintained
for individuals visiting within the development.
Guest parking may be reduced to .25 apace per unit for each unit
above 50 in a large residential development.
Paragraph (3) of Subsection (a) of Section 13-545 of the Costa
Mesa Municipal Code is hereby deleted.
SECTION 8•
Subsection (b) of Section 13-545 of the Costa Mesa Municipal
Code is hereby deleted.
SECTION 9:
Subsection (e) of Section 13-828 of the Costa Mesa Municipal
Code is hereby amended by adding Paragraph (3) to read as follows:

cent of the driveway and required open parking is paved in a
decorative nature and 2) the parking is provided in accordance
with this Ordinance (No. 92- 1) or a subsequent amendment."
SECTION 10:
Subsection (f) of Section 13-828 of the Costa Mesa Municipal
Code is hereby amended as follows:
"(f) The required parking for condominium projects shall be
provided per Section 13-545 and the following standards:
(1) Automatic garage door openers shall be required for each
garage.
SECTION 11:
Paragraphs (a) through (e) of Subsection (b) of Section 13-829
of the Costa Mesa Municipal Code are hereby renumbered as
Paragraphs (1) through (5).
SECTION 12•
Paragraph (3) of Subsection (b) of Section 13-829 of the Costa
Mesa Municipal Code is hereby amended as follows:
"(3) Provisions to restrict parking upon other than approved
and developed parking spaces and to require that garages be
kept open and available for tenant parking shall be written
into the covenants, conditions and restrictions for each
project."
SECTION 13: APPLICABILITY
This Ordinance shall not apply to projects which have received
Planning Approval (Development Review approval by Planning Division
or other discretionary approval by Planning Commission) by January
20, 1992. This Ordinance shall not apply to future pre -occupancy
conversion to condominiums of projects which were designed to
condominium standards but have received Planning approval as
apartments by January 20, 1992.
SECTION 14:
This Ordinance shall take effect and be in full force thirty
(30) days from and after the passage thereof, and prior to the
expiration of fifteen (15) days from its passage shall be published
once in the ORANGE COAST DAILY PILOT, a newspaper of general
circulation, printed and published in the City of Costa Mesa or, in
the alternative, the City Clerk may cause to be published a summary
of this Ordinance and a certified copy of the text of this
Ordinance shall be posted in the office of the City Clerk five (5)

days prior to the date of adoption of this Ordinance, and within
fifteen (15) days after adoption, the City Clerk shall cause to be
published the aforementioned summary and shall post in the office
of the City Clerk a certified copy of this Ordinance together with
the names of the members of the City Council voting for and against
the same.
