HomeMy WebLinkAbout92-03 Amending Permit Parking ProceduresORDINANCE NO. 92-3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AiMENDING SECTION 10-221.3 THROUGH 10-221.4 OF THE COSTA MESA MUNICIPAL CODE PERMIT PARKING PROCEDURES. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The Costa Mesa City Council does hereby find and declare as follows: WHEREAS, the City has by ordinance established a permit parking program (Costa Mesa Municipal Code Section 10-221 through 10-221.9) to address ingacts in certain residential areas from the Orange County Fair- grounds and the Pacific Amphitheater; and WHEREAS, recent action by the Transportation Commission to extend this prohibition would necessitate amending this section relative to fees for permits, appeal procedures, and issuance of permits; and WHEREAS, accordingly the Section 10-221.3 through 10-221.4 of the Costa Mesa Municipal Cade is amended as follows: SECTION 2. Subsections (a), (b) and (c) of Section 10-221.3 of the Costa Mesa Municipal Code is amended to read as follows: (a) To obtain a residential parking permit, the applicant shall per- sonally appear at the Costa Mesa Police Department Transportation Services Division and furnish his full, true name and home address, and proof of residence, arca shall state the make, year, model and registration and license plate numbers of each vehicle for which a permit is sought. (b) The transportation services manager or his designee shall grant or deny any permit applied for pursuant to this article. Any denial shall be in writing and shall state the reason for denial. Action upon an appli- cation shall not be unreasonably delayed. (c) Denial of an application pursuant to this article may be appealed to the transportation commission as provided in Title 2, Chapter IX, of this Code. Section 10-221.4. Fees; replacements. SECTION 3. Subsection (a) of Section 10-221.4 of the Costa Mesa Municipal Code is hereby amended to read as follows: (a) Fees for parking permits shall be set by resolution of the city council, except that no fee shall be charged to persons residing adjacent to the restricted segment of streets near the Orange County Fairgrounds. SECTION 4. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the ex- piration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall caused to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names and members of the City Council voting for and against the same.
