HomeMy WebLinkAbout04-08 - Environmental Impact Report No. 1050 for Newport Plaza Residences ProjectRESOLUTION NO. 04-8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CERTIFYING FINAL ENVIRONMENTAL IMPACT REPORT NO. 1050 FOR THE 1901 NEWPORT PLAZA RESIDENCES PROJECT LOCATED AT 1901 NEWPORT BOULEVARD IN THE PLANNED DEVELOPMENT COMMERCIAL (PDC) ZONE. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, Draft Environmental Impact Report (EIR) No. 1050 (State Clearinghouse Number 2002061128) has been prepared for the 1901 Newport Plaza residences project; and WHEREAS, the Draft EIR was prepared in accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines; and WHEREAS, the City of Costa Mesa circulated the Draft EIR between December 2, 2002 and January 24, 2003 for public comment and review; and WHEREAS, duly noticed public hearings were held by the Planning Commission on December 9, 2002, January 13, 2003, and February 24, 2003 and on April 14, May 5, May 19, June 2, July 7, 2003 and January 20, 2004 by the City Council to allow for public comment on the proposed project and Final EIR and with all persons having been given the opportunity to be heard both for and against the proposed project; and WHEREAS, the City of Costa Mesa received written and verbal comments from the public during and after the review period; and WHEREAS, written comments and oral testimony were responded to in the manner set forth in California Code of Regulations Section 15088(b) through Comments and Responses submitted to the City; and WHEREAS, the Planning Commission recommended that City Council certify Final EIR No. 1050 by adoption of Resolution No. PC -03-14 on February 24, 2003; and WHEREAS, the City Council considered and rejected on-site and off-site alternatives as infeasible or not superior to the proposed project site due to a failure to meet most of the basic project objectives, infeasibility for proposed development for reasons specified in Final EIR No. 1050, or inability to avoid significant environmental impacts; and WHEREAS, the City Council considered a letter from an independent, third - party review of the Draft EIR conducted by The Planning Center, an environmental consulting company, which expressed that the EIR was in compliance with State law and that the aesthetic analysis was fully supported by substantial evidence; and WHEREAS, the City Council has reviewed all environmental documents comprising the Final EIR and has found that the Final EIR considers all environmental impacts of the proposed project and a reasonable range of alternatives, and the Final EIR is complete and adequate and fully complies with all requirements of CEQA, the CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines; and WHEREAS, the Final EIR No. 1050 reflects the independent judgment of the City of Costa Mesa; and 2 WHEREAS, on April 14, 2003, the City Council adopted Resolution No. 03-19 certifying EiR No. 1050 as adequate and complete, but that on June 2, 2003, the City Council granted an application for rehearing the decision adopting that resolution and therefore, this Resolution No. 04-08 replaces Resolution No. [IK]ILe7 NOW THEREFORE, BE IT RESOLVED that the Costa Mesa City Council does hereby CERTIFY Final EIR No. 1050 as complete, adequately, and fully - supported by substantial evidence in that it addresses all environmental effects on the project and fully complies with the requirements of CEQA, the CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines.
