HomeMy WebLinkAbout04-10 - Revising the List of Designated Positions for the City's Conflict of Interest CodeORDINANCE NO. 04-10 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING CHAPTER X OF TITLE 2 OF THE COSTA MESA MUNICIPAL CODE REVISING THE LIST OF DESIGNATED POSITIONS FOR THE CITY'S CONFLICT OF INTEREST CODE THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: The City Council of the City of Costa Mesa, California, does hereby declare: WHEREAS, pursuant to the California Political Reform Act of 1974 every city is required to adopt a conflict of interest code and Costa Mesa has adopted its conflicts code, which appears in Costa Mesa Municipal Code Title 2, Chapter X; and WHEREAS, the Conflict of Interest Code contains a list of City officials and employees called "designated employees' whose positions involve the making or participation in the making of decisions that may foreseeably have a material financial effect on an economic interest of the employee; and WHEREAS, the Conflict of Interest Code is required to be amended from time to time to incorporate new state law requirements and update the list of positions of designated employees; and WHEREAS, the City's Conflict of Interest Code now needs to be amended to update the list of designated positions; and WHEREAS, the City desires to provide for a more efficient procedure with which to update the list of designated positions, NOW THEREFORE, the City Council of the City of Costa Mesa ordains as follows: Section 1. The list of designated positions shown on Appendix "A" to Section 2-401 is hereby replaced with the new, revised Appendix "A" that is attached hereto and incorporated herein. Section 2. Section 2-402 of the Costa Mesa Municipal Code is hereby amended by adding a new subdivision (d) to read as follows: "(d) The City Council may update the list of designated positions and employees shown on Appendix "A" by a City Council resolution." Section 3. This Ordinance shall take effect and be in full force thirty (30) days from and after the passage thereof, and prior to the expiration of fifteen (15) days from its passage shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance 2 together with the names and member of the City Council voting for and against the same. D puty City Jerk and ex -officio Clerk of the City Council of the City of Costa Mesa APPENDIX A Designated employees or officials are set forth by position or job classification and are intended to include one or more persons where one or more appointments have been or will be made to a classified position. A designated employee or official, for the purpose of this ordinance, shall include a spouse and immediate members of the family. Any person hired or promoted into a job classification included in this ordinance shall become a designated employee for the purposes of this ordinance without further action of the City Council.
