HomeMy WebLinkAbout91-11 - Adopt Penal Code Requirements Relating to Selection and Training Standards of Public Safety DispatchersORDINANCE NO. 91 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING TITLE 14 OF THE COSTA MESA MUNICIPAL CODE TO ADOPT THE PENAL CODE REQUIREMENTS RELATING TO THE SELECTION AND TRAINING STANDARDS OF PUBLIC SAFETY DISPATCHERS. SECTION 1. The City Council of the City of Costa Mesa declares as follows: WHEREAS, California Penal Code S 13510 has been amended to require the California Commission on Peace Officer Standards and Training (POST) to establish minimum selection and training standards for local public safety dispatchers; and WHEREAS, the Public Safety Dispatcher Program has been established for the purpose of raising the level of competence of local public safety dispatchers; and WHEREAS, California Penal Code S 13520 at seq. provides for reimbursement to public entities for certain associated training costs and the City of Costa Mesa desires to qualify to receive aid from the State of California under such provisions; and WHEREAS, the City of Costa Mesa desires to participate in the Public Safety Dispatcher Program and pledge adherence to the standards adopted by the Commission. ACCORDINGLY, the City Council of the City of Costa Mesa hereby amends Title 14 as follows: SECTION 2. Chapter V of Title 14 of the Costa Mesa Municipal Code is hereby added as follows: CHAPTER V. PUBLIC SAFETY DISPATCHER PROGRAM Section 14-75. Participation, Aid. The City of Costa Mesa desires to•participate in the Public Safety Dispatcher Program established by the California Commission on Peace Officer Standards and Training (POST) pursuant to California Penal Code Section 13510 and to receive aid for certain training costs from the State of California under the provisions of Penal Code Sections 13520 et seq. Section 14-76. Adherence to POST Standards. The City of Costa Mesa pledges that it shall adhere to the standards for recruitment and training established by the California Commission on Peace Officer Standards and Training (POST) as required for participation in the Public Safety Dispatcher Program. Section 14-77. Commission Inquiries. The California Commission on Peace Officer Standards and Training (POST) and its representatives may make such inquiries as deemed appropriate by the Commission to ascertain that the City's public safety dispatcher personnel adhere to the standards referenced in Section 14-75. _ Section 14-78. Withdrawal. Should the City of Costa Mesa decide that it is within its best interests to withdraw from the Public Safety Dispatcher Program, City may exercise such option in accordance with procedures for withdrawal established by the California Commission on Peace Officer Standards and Training (POST). SECTION 3. This Ordinance shall take effect and be in full force and effect thirty (30) days from and after its passage and, before the expiration of fifteen (15) days after its passage, shall be published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation printed and published in the City of Costa Mesa, or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk a certified copy of this Ordinance together with the names of the members of the City Council voting for and against the same. te..
