AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, ADDING ARTICLE 6 TO TITLE
2, CHAPTER V OF THE COSTA MESA MUNICIPAL CODE
PERTAINING TO THE USE OF THE CITY'S GENERAL FUND
OPERATING RESERVE.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. The City Council of the City of Costa Mesa finds and declares as follows:
WHEREAS, the use of the City's General Fund Operating Reserve has a significant
impact on the City's financial stability; and
WHEREAS, prudent financial accountability dictates that a policy regarding the use of
General Fund Operating Reserves be established; and
WHEREAS, a General Fund Operating Reserve is necessary to protect the City's financial
well being; and
WHEREAS, such a policy would ensure that the City had the financial assets to mitigate
the effects of an emergency and/or unique demands.
SECTION 2. The City Council of the City of Costa Mesa hereby adds Article 6 to
Chapter V of Title 2 of the Costa Mesa Municipal Code as follows:
ARTICLE 6. USE OF GENERAL FUND CASH RESERVES'
Section 2-205. Definitions.
For the purpose of this chapter, the following terms shall have the following meaning
unless it is clear from the context that a different meaning is intended.
(a) The term, "General Fund" means the fund used to account for all financial resources
except those required to be accounted for in another fund.
(b) The term, "General Fund Operating Reserve" means those unappropriated cash funds
from the General Fund which have been designated by Resolution of the City Council as
Operating Reserve.
Section 2-206. Limited Use
The use of the General Fund Operating Reserve shall be limited to the following purposes:
(a) To provide required emergency funding as a result of a declared emergency.
(b) To provide required funding for an unanticipated but urgent event threatening the
public health, safety and welfare of the City of Costa Mesa.
Section 2-207. Accessing the General Fund Reserve Balance
The General Fund Operating Reserve may only he utilized by resolution of the City
Council for any General Fund purpose so provided in Section 2.
SECTION 3. Publication
This Ordinance shall take effect and be in full force and effect thirty (30) days from and
after its passage and, before the expiration of fifteen (15) days after its passage, shall be
published once in the ORANGE COAST DAILY PILOT, a newspaper of general circulation,
printed and published in the City of Costa Mesa, or, in the alternative, the City Clerk may cause
to be published a summary of this Ordinance and a certified copy of the text of this Ordinance
shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this
Ordinance, and within fifteen (15) days after adoption, the City Clerk shall cause to be published
the aforementioned summary and shall post in the office of the City Clerk a certified copy of this
Ordinance together with the names of the members of the City Council voting for and against
the same.
