A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, RELATING TO THE
PROVISION OF A CITY OF COSTA MESA VENDOR
PREFERENCE IN THE PURCHASE OF SUPPLIES,
EQUIPMENT AND SERVICES.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, Costa Mesa Municipal Section 2-171(e) authorizes the City Council
to establish a City of Costa Mesa Vendor Preference; and
WHEREAS, the City Council encourages local businesses and economically
supports local business; and
WHEREAS, the City Council would like to provide commensurate recognition
of the actual contributions that local businesses provide to the community; and
WHEREAS, patronage of local businesses benefit the economic base of the City
of Costa Mesa as a whole, as well as the revenue base through which public safety and
other services are provided to the community as a whole.
NOW, THEREFORE, BE IT RESOLVED THAT in awarding purchase orders and
contracts for supplies, equipment or services, the City Council, or a city official
authorized to award a contract, may grant a preference of five percent (5%) to Costa
Mesa Vendors. This means that Costa Mesa Vendors' bids or proposed contract costs
will be deemed lowered by 5% when comparing it to the bids or contract costs of other
vendors. The City of Costa Mesa Vendor Preference shall be utilized solely for the
purpose of determining to whom the contract should be awarded and shall not have the
effect of altering the final contract amount of any such Costa Mesa Vendor. In no event
shall the City of Costa Mesa Vendor Preference exceed $5,000 for any single purchase
order or contract, nor shall it apply to a Public Project as that term is defined in
California Public Contract Code Section 20161,
BE IT FURTHER RESOLVED, that for purposes of this resolution, a Costa Mesa
Vendor is defined as a business, firm or enterprise that (a) has at least one fixed office
and a locally taxable distribution point within the City and (b) holds a valid business
license bearing a street address within the City.
