A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
COSTA MESA, CALIFORNIA, APPROVING MASTER PLAN
AMENDMENT/MINOR CONDITIONAL USE PERMIT PA -03-37.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS,,an application was filed by Pat Merwin of IKEA with respect to the real
property located at 1475 South Coast Drive, requesting approval of a master plan
amendment, with a minor conditional use permit to allow compact parking, to construct a
new parking lot in the PDC zone; and
WHEREAS, a duly noticed public hearing was held by the Planning Commission
on October 27, 2003.
WHEREAS, on October 27, 2003, the Planning Commission recommended
approval of Master Plan Amendment/Minor Conditional Use Permit PA -03-37; and
2003.
WHEREAS, the City Council held a duly noticed public hearing on November 17,
NOW THEREFORE BE IT RESOLVED that, based on the evidence in the record
and the findings contained in Exhibit "A", and subject to the conditions contained in
Exhibit "B", the City Council hereby approves Master Plan Amendment/Minor
Conditional Use Permit PA -03-37 with respect to the property described above.
BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find
and determine that adoption of this resolution is expressly predicated upon the activity
as described in the staff report for Master Plan Amendment/Minor Conditional Use
Permit PA -03-37, and upon applicant's compliance with each and all of the conditions
contained in Exhibit "B". Should any material change occur in the operation, or should _
the applicant fail to comply with the conditions of approval, then this resolution, and any
recommendation for approval herein contained, shall be deemed null and. void'. Any "
approval granted by this resolution shall be subject to review, modification, or revocation
if there is a material change that occurs in the operation, or. -if the applicant fails to
comply with any of the conditions of approval.

EXHIBIT "A"
FINDINGS
A. The master plan amendment meets the broader goals of the 2000 General Plan,
the North Costa Mesa Specific Plan, and the Zoning Code by exhibiting excellence
in design, .site planning, integration of uses and structures, and ,protection of the
integrity of neighboring development. Specifically, the proposed amendment will
reduce the overall building square footage, floor area ratio, and trip budget
originally. approved for Home Ranch. The parking lot will be fully improved,
including setback and interior landscaping to match the remainder of the IKEA
project.
B. The information presented substantially complies with Costa Mesa Municipal Code
section 13-29(g)(2) in that the proposed compact parking is substantially compatible
with developments in the same general area. Granting the minor conditional use
permit will not be detrimental to the health, safety and general welfare of the public or
other properties or improvements within the immediate vicinity. Specifically, only 20
of the 1,643 parking spaces will be compact and are located in a side parking lot
away from the main entry of the building, where the majority of the customers will
park. Granting the minor conditional use permit will not allow a use, density or
intensity which is not in accordance with the general plan designation and specific
plan for the property. -
C. Section 15168 (c) (2) of the CEQA guidelines allows a lead agency to use a
previously -certified final program Environmental Impact Report (EIR) for subsequent
activities, if the finding can be made that no new effects would occur and no new
mitigation measures would be required. The proposed project is within the scope of
Final EIR #1048 for the following reasons:
1. The proposed project will not allow a land use intensity and/or density that
would be inconsistent with the corresponding 2000 General Plan land use
designation. Therefore, the proposed project will not alter the impact
analyses contained in Final EIR #1048.
2. There have not been substantial changes with respect to the circumstances
under which the project will be undertaken that would require important
revisions to previous final EIR due to the involvement of new significant
environmental impacts not covered in the previous final EIR.
3. No new information of substantial importance to the project has become
available in respect to the significant effects of the project, the severity of
the significant effects, the feasibility of the mitigation measures and
alternatives, or the identification of new mitigation measures or alternatives
that could lessen the significant effects of the project.
4. Because there is no change to the impact analyses contained in Final EIR
#1048 and no new information. of substantial importance has ' become
available, no new mitigation measures would be required as a result of
approval of the project.
D. The project is exempt from Chapter XII, Article 3, Transportation System
Management, of Title 13 of the Costa Mesa Municipal Code.
EXHIBIT "B"
CONDITIONS OF APPROVAL
Ping. . 1.
Applicant is reminded that all applicable mitigation measures of Final
Program El #1048 still apply.
2.
Development rights granted to this parcel under the original Home Ranch
approval shall not be transferred elsewhere in Home Ranch.
3.
The bumper overhang area shall be provided outside the required 20 -foot
deep landscaped setback area along South Coast Drive and Susan
Street.
4.
A maximum of 20 compact parking spaces shall be permitted for the
entire IKEA project.
5.
A lot line adjustment to combine the two lots into one shall be processed
and recorded prior to the release of building permits for the parking lot
improvements.
6.
Show method of screening for all ground -mounted equipment (backflow
prevention devices, Fire Department connections, electrical transformers,
etc.). Ground -mounted equipment shall not be located in any
landscaped setback visible from the street, except when required by
applicable uniform codes, and shall be screened from view, under the
direction of Planning staff.
7.
The conditions of approval and ordinance or code provisions and special
district requirements of Master Plan Amendment PA-03-37/Specific Plan
Amendment SP -03-02 shall be blueprinted on the face of the site plan.
8.
The applicant shall contact the Planning Division to arrange for an
inspection of ,the site prior to final inspections by the Building Division. This
inspection is to confirm that the conditions of approval and code
requirements have been satisfied.
Eng. 9.
Maintain the public right-of-way in a "wet -down" condition to prevent
excessive dust and remove any spillage from the public right-of-way by
sweeping or sprinkling.
Police 10.
A list of security recommendations has been provided by the Police
Department for the applicant's consideration.
CODE REQUIREMENTS
The following list of federal, state and local laws applicable to the project has been
compiled by staff for the applicant's reference. Any reference to "City" pertains to the
City of Costa Mesa.
Ping. 1. Redesign the parallel parking to comply with Code requirements.
2. All contractors and subcontractors must have valid business licenses to do
business in the City of Costa Mesa. Final inspections will not be granted
until all such licenses have been obtained.
3.
Four (4) sets of detailed landscape and irrigation plans shall be required as
part of the project plan check review and approval process. Three (3) sets
shall be provided to the representative water agency and one (1) set shall
be submitted to the Planning Division for review. Plans shall be approved
by the water agency with two (2) approved sets. forwarded by the applicant
to the Planning Division for final approval prior to issuance of building
permits.
4.
Two (2) sets of landscape and irrigation plans, approved by both the water
agency and the Planning Division, shall be attached to two of the final
building plan sets.
5.
Landscape and irrigation plans shall meet the requirements set forth in
Costa Mesa Municipal Code Sections 13-101 through 13-108 as well as
irrigation requirements set forth by the water agency. Consult with the
representative water agency Mesa Consolidated Water District, Chris Blank
- (949) 631-1291 for requirements.
6.
Landscaping and irrigation shall be installed in accordance with the
approved plans prior to final inspection or occupancy clearance.
7.
All landscaped areas shall be separated from paved vehicular areas by 6"
high continuous Portland Cement Concrete curbing.
8.
In compliance with the City's mitigation monitoring program, the -applicant
shall submit a compliance report to the Planning Division along with plans
for plan check, or prior to commencement of the project's activity if no
construction is involved, that lists each mitigation measure and states when
and how the mitigation measures are to be met.
Bldg. 9.
Comply with the requirements of the California Code of Regulations, Title
24, also known as the California Building Standards Code, as amended
by the City of Costa Mesa.
10.
Prior to the submittal of plans for grading, the applicant shall prepare and
submit documentation for compliance with the State Water Resources
Control Board (SWRCB) Water Quality Order 99-08-DWQ; National
Pollutant Discharge Elimination System (NPDES) Permit No.
CAS000002 for Storm Water Discharges Associated with Construction
Activity (General Permit); the California Regional Water Quality Control
Board (RWQCB) Santa Ana Region Order No. R8-2002-0010 and
NPDES Permit No. CAS618030; and, the City of Costa Mesa Ordinance
No. 97-20 for compliance with NPDES Permit for the City of Costa Mesa.
Such documentation shall include a Storm Water Pollution Prevention
Plan if over 1 acre (if over 5 acres if submitted prior to March 10, 2003)
and a Water Quality Management Plan (WQMP) identifying and detailing
the implementation of the applicable Best Management Practices
(BMPs).
Eng. 11.
At the time of development submit for approval an off-site plan to the
Engineering Division and grading plan to the Building Division that shows
sewer, water, existing parkway improvements and the limits of work on the
site, and hydrology calculations, both prepared by a civil engineer or
architect. Construction access approval must be obtained prior to building
or engineering permits being issued by the City of Costa Mesa. Pay offsite
plan check fee to the Engineering Division. An approved offsite plan and
fee shall be required prior to engineering%utility permits being issued by the
City.
12. A site access permit and deposit of $750.00 for street sweeping will be
required by the Engineering Division prior to the start of any on- or off-site
work.
13. Fulfill drainage ordinance fee requirements prior to approval of plans.
14. Design storm water run-off to connect into the existing storm drain within
IKEA's storm drain system.
15. Provide proof of cross lot drainage easement.
16. Not storm run-off or landscape irrigation run-off allowed to flow to South
Coast Drive or Susan Street.
SPECIAL DISTRICT REQUIREMENTS
The requirements of the following special districts are hereby forwarded to the applicant:
CDFA 1. Comply with the requirements of the California Department of Food and
Agriculture (CDFA) to determine if red imported fire ants exist on the property
prior to any soil movement or excavation. Call CDFA at (714) 708-1910 for
information.
AQMD 2. Applicant shall contact the Air Quality Management District (AQMD) at (800)
288-7664 for potential additional conditions of development or for additional
permits required by AQMD.
