RECOMMENDATION:
1. Adopt plans, specifications, and working details for Traffic Congestion Relief Fund
(TCRF) Project, City Project No. 09-28.
2. Approve Budget Adjustment No. 10-018 (Attachment I ") in the amount of $969,284.
3. Award a construction contract to Elite Bobcat Services, 1320 East 6t" Street, #100,
Corona, California, 92879, in the amount of $974,567.63.
4. Authorize the Mayor and the City Clerk to execute the Public Works Agreement.
BACKGROUND:
Based on staff's observations and recommendations from the City's Pavement
Management System, the following streets are in need of pavement rehabilitation at this
time:

ANALYSIS:
The pavement rehabilitation for the above listed street segments consists of milling and
overlaying with new asphalt concrete, with the exception of Monterey Avenue and Elden
Avenue, which are to receive a slurry seal treatment. Additional work under this contract
includes localized reconstruction of damaged curb and gutter, sidewalks, driveway
approaches, and construction of curb ramps; traffic control; traffic striping; and all other
incidental work necessary to complete the project.
On December 23, 2009, the City Clerk received and opened eight (8) bids for this project.
Elite Bobcat Service, Inc. was the apparent low bidder with a bid proposal of $974,567.63.
The Engineer's estimate was $1,228,051.00; and the average of the eight (8) bids received
for this project amounted to $1,065.582.36.
An analysis of the bids indicates that the apparent low bidder submitted a proposal that is
twenty percent (20%) lower than the Engineer's estimate. The variance between the low
bidder and the Engineer's estimate may be attributed to the highly competitive conditions in
the construction industry at this time. The Bid Abstract is included as Attachment "2".
The license and references of Elite Bobcat Services, Inc. were checked and staff has found
them to be in good standing. Elite Bobcat Services, Inc. has successfully completed
several projects in the City of Costa Mesa including most recently sidewalk improvements
on Broadway and Shalimar Drive.
ALTERNATIVES CONSIDERED:
An alternative to this Council action would be to reject all the bids. If all the bids were
rejected, the City would need to readvertise or cancel the project. Staff does not
recommend this alternative as it would delay the project by several months and may not
result in lower bids.
FISCAL REVIEW:
The City received $969,284 from the Traffic Congestion Relief Fund (TCRF) program in
FY 08-09 as partial funding for this project. These funds are available as undesignated
fund balance in the Gas Tax Fund. The balance of funds necessary to complete this
project is available from existing Gas Tax Fund — Citywide Street Maintenance project
appropriations.
The attached Budget Adjustment No. 10-018 appropriates the TCRF and Gas Tax funds
for this project.
LEGAL REVIEW:
Elite Bobcat Services, Inc. has furnished the necessary bonds and insurance, which have
been approved as to form by the City Attorney. After the award and subsequent execution
of the contract, a "Notice to Proceed" will be issued.

CONCLUSION:
The City has received bids for the Traffic Congestion Relief Fund (TCRF) Project, City
Project No. 09-28. Staff has evaluated all of the bids and recommends that the City
Council adopt the plans, specifications, and working details for said project; approve
Budget Adjustment No. 10-018, in the amount of $969,284; award the contract to the
apparent low bidder Elite Bobcat Services, Inc. in the amount of $974,567.63; and
authorize the Mayor and the City Clerk to execute the Public Works Agreement.
