RECOMMENDATION:
1. Accept the work performed by ICE Engineering, Inc., and authorize the City Clerk to file the Notice
of Completion.
2. Release the Labor and Material Bond seven (7) months after the filing date; release the Faithful
Performance Bond one (1) year after the filing date; and release the retention monies 35 days
after the Notice of Completion filing date.
BACKGROUND:
On July 7, 2009, a construction contract in the amount of $407,473.50 was awarded to ICE
Engineering, Inc., 19042 San Jose Avenue, Unit L, City of Industry, California, 91748.
Shalimar Drive, Wallace Avenue, James Street, and West 18th Street received localized
reconstruction of segments of curb and gutter, concrete sidewalk, and driveway approaches. In
addition, the bollards closing Wallace Avenue to through -traffic at West 18th Street were removed, and
a new cul-de-sac was constructed. Furthermore, Shalimar Street received full depth removal and
reconstruction of the existing asphalt pavement section.
ANALYSIS:
The work required by the contract documents was completed on December 30, 2009, to the
satisfaction of the City Engineer. The final contract cost amounted $380,613.88. A report of the final
costs is shown herein as Attachment "1 ".
A summary of the costs is as follows:
Original Contract Cost: $407,473.50
Change Order No. 1: ($ 684.76)
Quantity Adjustment: ($ 26,174.86)
Final Contract Cost: $380,613.88

A negative Change Order No. 1 in the amount of $684.76 was issued to plant six palm trees, construction
of a new cross gutter at the intersection of Pomona Avenue and James Street, providing striping and
signing modifications on a time and materials basis, and for deleting portions of contract work that were
deemed unnecessary.
The final contract price reflects a seven percent (7%) decrease to the original contract as a result of the
aforementioned change order and quantity adjustment.
As of this date, there are no Stop Notices filed against the monies due to ICE Engineering, Inc.

There were no alternatives considered for this item.
FISCAL REVIEW:
There is no fiscal impact due to this item.
LEGAL REVIEW:
There is no legal review required on this item.
CONCLUSION:
The 2008-2009 Community Development Block Grant (CDBG) Street Improvements Project has been
completed. It is recommended that the City Council authorize staff to file the Notice of Completion;
release the remaining retention monies 35 days after the Notice of Completion filing date; and release
the bonds accordingly.
