RECOMMENDATION
1. Approve the attached resolution (Attachment 1) for the submittal of a grant application to the
State of California's Urban Greening Grant Program under the Safe Drinking Water, Water
Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006
(Proposition 84) for the Fairview Channel Multipurpose Trail Project.
2. Authorize the Department of Public Services Director as the City's representative.
BACKGROUND
On November 7, 2006, California voters passed Proposition 84. Funding for the State of
California's Urban Greening Grant Program was made available through the Sustainable
Communities and Climate Change Reduction Chapter in Proposition 84. Grant applications for the
State of California's Urban Greening Grant Program are due on April 30, 2010. Grant awards will
be made in October 2010.
ANALYSIS
The City's grant application to the Urban Greening Grant Program will be for $500,000. No City
match is required to apply for this grant program. Funding will pay for the development of a half
mile multipurpose trail in the lower northern portion of Fairview Park. The trail will connect
Placentia Avenue with the Santa Ana River Bicycle Trail along the Santa Ana River. Plans and
specifications for this project have been completed by City staff and a consultant.
If grant funding is approved, construction will begin in late 2011 with completion estimated to occur
by the summer of 2012. To apply for these grant funds a resolution approving the filing of an
application and naming the Public Services Director as the City's authorized representative is
needed.
ALTERNATIVES CONSIDERED
If City Council chooses not to submit a grant application for this project, staff will continue to pursue
other grant programs and alternative funding.
FISCAL REVIEW
No City match is required for this grant program.
LEGAL REVIEW
The proposed resolution is approved as to form.
CONCLUSION
It is recommended that City Council approve the filing of a grant application with the State of
California's Urban Greening Grant Program under the Safe Drinking Water, Water Quality and
Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) for the
Fairview Channel Multipurpose Trail Project and authorize the Public Services Director as the
City's representative.

APPROVING THE APPLICATION FOR GRANT FUNDS FOR
THE URBAN GREENING GRANT PROGRAM UNDER THE SAFE DRINKING

WHEREAS, the Legislature and GoverrZor Of the State of California have
provided funds for the program shown abova ; and
WHEREAS, the Strategic Growth Council has been delegated the
responsibill(y for the administration of this grant program, establishing necessary
procedures; and
WHEREAS, said procedures established by the Strategic Growth Council
require a resolution certifying the approval of applicatiori(s) by the Applicants
governing board before submission of said applrcation(s) to the State; and

NOW, THEREPORE, BE IT RESOLVED that the CITY COUNCIL OF THE CITY
OF COSTA MESA
1, Approves the filing of an application for the Fairview Channel Multipurpose
Trail Project;
_ Certifies that applicant understand the assurances and certification in the
application, and
. Certifies that applicant or title holder will have sufficient funds to operate and
maintain the project consistent w1th the land tenure rectuirernents; or will secure
the resources to do so, and
4. Certifies that it will comply w th the provisions of Section 1771.8 of the State
Labor Code regarding payment of prevailing wages on Projects awarded
Proposition 50 Funds, and
5_ If applicable, certifies that the project w[l] comply wilkh any laws and regulations
including, but not limited to, legal requirements for building cedes, health and
safety codes, disabled access laves, environmental laws and, Haat prior to
commencement of construction. all applicable permits will have been obtained,
and
6, Certifies that applicant will work towards the Governor's State Plan [ling
Priorities intended to prornote equity. strengthen the economy, protect the
environment, and promote public health and safety as included in Government
Code Section 656411, and
7. Appoints the D rector of Public Works of designee, as agent to conduct all
negotiations, execute and submit all documents including, bUt not limited to
applicationsr agreements. payment requests and so on, which rn@y be necessary
for the completion of the aforementioned project(s).
