RECOMMENDATION
Approve the attached resolution (Attachment 1) for the submittal of a grant application to
the State of California's Urban Greening Grant Program under the Safe Drinking Water,
Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006
(Proposition 84) for the Fairview Park Wetlands and Riparian Habitat Project, Phase 11.
2. Authorize the Department of Public Services Director as the City's representative.
BACKGROUND
On November 7, 2006, California voters passed Proposition 84. Funding for the State of
California's Urban Greening Grant Program was made available through the Sustainable
Communities and Climate Change Reduction Chapter in Proposition 84. Grant applications for the
State of California's Urban Greening Grant Program are due on April 30, 2010. Grant awards will
be made in October 2010.
ANALYSIS
The City's grant application to the Urban Greening Grant Program will be for $950,000, and
there is no City match required. Funding will pay for the retrofit of the existing pump station at
the Greenville Banning Channel, installation of a 10" waterline, and excavation of the wetlands
pond and plant native habitat. The completion of Phase II would create fully functioning
wetlands at Fairview Park. Phase I of the project was completed in September of 2009. Phase
III has been designed and staff has submitted several grant applications to fund its completion.
If grant funding is approved, construction will begin in late 2011 with completion estimated to occur
by the fall of 2012. To apply for these grant funds a resolution approving the filing of an application
and naming the Public Services Director as the City's authorized representative is needed.
ALTERNATIVES CONSIDERED
If City Council chooses not to submit a grant application for this project, staff will continue to pursue
other grant programs and alternative funding.
FISCAL REVIEW
No City match is required for this grant program.
LEGAL REVIEW
The proposed resolution is approved as to form.
CONCLUSION
It is recommended that City Council approve the filing of a grant application with the State of
California's Urban Greening Grant Program under the Safe Drinking Water, Water Quality and
Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) for the
Fairview Park Wetlands and Riparian Habitat Project, Phase II, and authorize the Public
Services Director as the City's representative.

WHEREAS, the Legislature and Governor of the State of California have
provided funds for the program shown above. and
WHEREAS, the Strategic Growth Council has been delegated the
respons,ibility for the administration of this grant program, establishing necessary
procedures; and
WHEREAS, said procedures established by the Strategic Growth CoLincil
regUire a resolution certifying the approval of application(s) by the Applicants
governing board before submission of said application(s) to the State, and
WHEREAS, the applicant, if selected, w3fl enter into an agreement with the
State of California to carr} out the Project
NOW, THERE FORE, BE IT RESOLVED that the CITY COUNCIL OF THE CITE`
OF COSTA MESA
1. Approves the filing of an application for the Fairview Park Wetlands and
Riparian Habitat Profect, Phase CI:
Certifies that applicant understands the asst,ranc s and certification in the
application, and
_ Certifies that applicant or title molder will have sufficient funds to operate and
maintaln the project consistent with the land tenure requirements; or will secure
the resources to do so, and
4_ Certifies that it will comply with the provisions of Section 1771,8 of the State
Labor Code regarding payrnent of prevailing wages cn Projects awarded
Proposition 50 Funds, and
5. If applicable. certifies that the project will comply with any laws and reguiations
€ncluding. but not limited to, legal requirements for building codes, health and
safety codes. disabled access laws. environmental laws and, that prior to
commencement of construction, all applicable permits will have been obtained,
and
6. Certifies that applicant will work towards the Govefnor's State Planning
Priorities intended to promote equity. strengthen the economy, protect the
environment, and promote public health and safety as included in Government
Code Section 65041. 1, and
7, Appoints the Director of Public Works or designee, as agent to canduct all
negatiationsr executo and submit all documents including, but not limited to
applicationsr agreements. payment requests and so on. which may be necessary
for the completion of the af ore rn e n ti on ed projec€(a).
