RECOMMENDED ACTION
Release the Performance and Labor and Material Bonds (Certificate No. 457591) in the amount
of $487,500 each to Mesa Placentia 17 LP (Developer), P.O. Box 8083, Newport Beach,
California, 92658.
BACKGROUND
On February 12, 2007, the City Planning Commission approved Parcel Map No. 2006-286 to
subdivide an existing industrial building for condominium purposes. As part of the conditions of
approval, the Engineering Division required the upgrade of an existing 24 -inch diameter
corrugated metal pipe (CMP) storm drain system shared by this property and the three adjoining
properties (south and east of 755 West 171" Street). This section of CMP is approximately 450
feet in length and connects into a larger concrete pipe system. The CMP was over 36 years old
and was beginning to show signs of deterioration which could have lead to leakage and
potential collapse. The Engineering staff recommended the relining of the CMP with a high
strength PVC material. The Performance and Labor and Materials Bonds in the amount of
$487,500 each were received and accepted by the Public Services Department as a guarantee
for the construction of the improvements.
ANALYSIS
All conditions of Parcel Map No. 2006-286 have been met and the work has been completed
and accepted by the City Engineer.
ALTERNATIVES CONSIDERED
The alternative to this Council action would be to retain the Performance and Labor and Material
Bonds. Costa Mesa Municipal Code Section 15-32 states, "The condition of said bond shall be
that the applicant will perform the work authorized by any permit issued pursuant to this chapter
in a good and workmanlike manner and to the satisfaction of the City Engineer." These
conditions have been met; therefore, retention of the bonds would be in violation of the
Municipal Code.
FISCAL REVIEW
There is no fiscal impact to the City relative to this item.
LEGAL REVIEW
There is no legal review required relative to this item.
CONCLUSION
All of the required conditions of Parcel Map No. 2006-286 have been completed by the
Developer. Therefore, staff recommends that the Performance and Labor and Material Bonds
in the amount of $487,500 each be released to Mesa Placentia 17 LP, a California Limited
Partnership.
