Adopt plans, specifications, and working details for Joann Street Bike Trail Improvements, Federal Project No. RPSTPLE - 5312 (075), City Project No. 09-17. 2. Approve Budget Adjustment No. 11-003 (Attachment 1), in the amount of $179,668.00. 3. Award a construction contract to MG Construction & Development, Inc., 8900 Eton Avenue #C, Canoga Park, California, 91304 in the amount of $1,229,435.48 (base bid plus Additive Bid Item A-2). 4. Authorize the Mayor and the City Clerk to execute the Public Works Agreement. BACKGROUND: The Joann Street Bike Trail is part of the City's Master Plan of Bikeways. This section of trail provides an outstanding pedestrian and bicycle corridor for local commuters to access business, educational, recreational, and residential facilities. The Joann Street Bike Trail Project starts at the southwest corner of Harbor Boulevard and Fair Drive, just south of the entrance to Fairview Developmental Center. The project then continues south to 2299 Harbor Boulevard where it turns west to approximately 1,000 feet east of Placentia Avenue. The length of the bike trail within the project limits is approximately 5,100 feet long, and consists of an 8 -foot wide, asphalt paved trail with earthen shoulders of varying widths on both sides of the trail, which are currently not irrigated or planted. The Joann Street Bike Trail Project was initiated a few years ago when residents along Joann Street, Fire, Maintenance, and Police staff voiced concerns regarding the attractive nuisance of its physical condition. The main issues raised were the dilapidated condition of the trail, fences, ongoing vandalism, lack of lighting and landscape, and particularly a maintenance -intensive aging asphalt concrete path. Staff worked closely with these groups to develop conceptual designs that led to Council approval of the final concept plan for the project (Attachment 2) in April 2008. The proposed scope of work in this contract is reflective of the approved conceptual plans and will enhance the safety and aesthetics of the Joann Street Bicycle Trail making it a first class element of the City's Bike Trail System. The construction and environmental compliance documents were completed by CNC Engineering in 2009. Caltrans approved the Authorization to Proceed with construction on June 1, 2010, and the project was subsequently advertised for construction. ANALYSIS: The scope of work consists of the removal and replacement of existing fencing along the south side of the trail from Harbor Boulevard to its westerly limits; removal of interfering vegetation and trees; grading; construction of irrigation and landscape improvements; installation of low-level, energy-efficient safety lighting; and rehabilitation of the existing trail. The plant material will consist of drought tolerant ground cover, shrubs, and trees irrigated with reclaimed water and controlled with state-of-the-art irrigation equipment. Attachment 2 depicts renderings of the improvements based on the above scope of work. The City Clerk received and opened eight (8) bids for this project on August 9, 2010. MG Construction & Development, Inc. was the apparent low bidder with a base bid proposal of $1,079,470.22. The Engineer's estimate was $1,468,377.00; and the average of the eight bids received for this project amounted to $1,538,774.99. An analysis of the bids indicates that the apparent low bidder submitted a proposal that is twenty - six percent (26%) lower than the Engineer's estimate. The variance between the low bidder and the Engineer's estimate may be attributed to continued competitive conditions in the construction industry at this time. The Bid Abstract is included as Attachment "3". The proposal schedule included additive bid items to be considered depending on funding availability. One of the additive bid items is A-2 which provides for the entire bike trail to be rehabilitated with concrete instead of being partially rehabilitated with asphalt and slurry seal. By incorporating this bid item, the net increase to the contract is $149,965.26. Since the amount of the base bid plus Additive Bid Item No. A-2 is within the available funding limits, staff recommends the inclusion of this additive bid item to maximize the available grant funding and to add this important feature which will prolong the life of the bike trail and reduce the City's future maintenance liability. The license and references of MG Construction & Development, Inc. were checked and staff has found them to be in good standing. ALTERNATIVES CONSIDERED: The alternative to this Council action would be to reject all the bids. If all the bids were rejected, the City would need to readvertise or cancel the project. Staff believes that readvertising the project will not result in lower bids. FISCAL REVIEW: Funding for the Joann Street Bike Trail Project is available from a variety of revenue sources including: Air Quality Management District (AQMD), Gas Tax, Park Development Fees, Community Development Block Grant (CDBG) and a Transportation Enhancement grant that reimburses qualifying expenditures up to $500,000. A Budget Adjustment is required to encumber the Gas Tax revenues for this contract. LEGAL REVIEW: MG Construction & Development, Inc. will furnish the necessary bonds and insurance prior to the commencement of work, scheduled for January 2011, subject to approval by the City Attorney. After the award and subsequent execution of the contract, a "Notice to Proceed" will be issued. E CONCLUSION: The City has received bids for the Joann Street Bike Trail Improvements, Federal Project No. RPSTPLE - 5312 (075), City Project No. 09-17. Staff has evaluated all of the bids and recommends that the City Council adopt the plans, specifications, and working details for said project; approve Budget Adjustment No. 11-003 in the amount of $179,668.00, award the contract to the apparent low bidder MG Construction and Development, Inc. in the amount of $1,229,435.48 (base bid plus Additive Bid Item A-2); and authorize the Mayor and the City Clerk to execute the Public Works Agreement.
