Adopt Resolution: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 2, 2010; DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW. 2. Declare adopted Ordinance No. 10-18: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA REPEALING AND REPLACING SECTION 16-68 OF CHAPTER IV OF THE COSTA MESA MUNICIPAL CODE REGARDING THE CITY'S TRANSIENT OCCUPANY TAX. 3. Swearing in of newly elected City Council Members by City Clerk. BACKGROUND: Pursuant to the Costa Mesa Municipal Code Section 2-14, the City's general municipal elections are held in November of even -numbered years, concurrent with the statewide elections. Two (2) council member seats, each serving a full term of four years, were available in the General Municipal election, held November 2, 2010. In addition, Measure L was placed on the ballot for voter consideration to ask the following question: YES Shall the City increase the existing Transient Occupancy Tax from 6% to 8%, which tax is, and will continue to be, imposed only on transients occupying NO hotels and motels within the City, for the funding of general city services and programs? As authorized by Resolution No. 10-36 and Resolution No. 10-45, the election was consolidated with the Orange County Registrar of Voters, who conducted the elections and provided such services that included, in part, the printing of the sample ballots, coordinating of the precinct boards and polling locations, issuing of absentee ballots, processing and counting of the returned ballots, absentee and provisional ballots. The results of that election have been certified by the Board of Supervisors and their certification of the results and Statement of Votes are attached to the resolution as "Exhibit A". The nomination period for qualified candidates was from July 12, 2010, through August 6, 2010. Upon certification of the nomination papers returned, five (5) candidates qualified for the ballot. The following is a list of the qualified candidates as their names appeared on the ballot and in ballot order: JIM RIGHEIMER, WENDY LEECE, SUE LESTER, CHAD W. PETSCHL, AND CHRIS MCEVOY. ANALYSIS: The total voter registration in Costa Mesa is 56,825 voters. The results were certified by the Board of Supervisors on November 22, 2010, are considered final and are now forwarded to the City Council for approval. The number of ballots cast in the election was 29,816 or 52 percent voter turnout. The count reflects the total number of ballots cast by the city's electorate either by vote - by -mail or at the polling location. The results of the election indicate that the top two (2) candidates to succeed to the City Council, having received the most votes, are: Jim Righeimer and Wendy Leece. In addition, the final results of the votes cast for Measure L reflect that 14,227 were in support of the measure and 13,048 did not support the measure. Requiring only a majority vote Measure L is therefore approved and Ordinance No. 10-18 is adopted (Attachment 2) as approved by the voters at the election. ALTERNATIVES CONSIDERED: No alternatives have been considered, as it is a State Code requirement that the results, certified by the Board of the Supervisors, also be certified by the City Council. FISCAL REVIEW: No fiscal review was required for the declaration of results. LEGAL REVIEW: Legal has reviewed the resolution and approved it as to form. CONCLUSION: The election was held and conducted as required by law and the results have been determined. It is requested that the City Council adopt the attached resolution certifying E the results of the election, approve the voter adopted Ordinance No. 10-18, followed by the swearing into office of the newly elected City Council Members by the City Clerk. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 2, 2010; DECLARING THE RESULTS AND SUCH -O -T -HER MA-TT-ERS-AS-P-ROVIDE-D-B-Y-L-AW. WHEREAS, a General Municipal Election was held and conducted in the City of Costa Mesa, California, on Tuesday, November 2, 2010, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed; and that in all respects, the election was held and conducted, and votes were cast, received, and canvassed, and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California for holding elections in general law cities; and WHEREAS, pursuant to Resolution No. 10-36, adopted June 1, 2010, and Resolution No. 10-45, adopted June 22, 2010, the election was consolidated with the Statewide General Election; the Registrar of Voters of the County of Orange canvassed the returns of the election, certified the results to this City Council, and the results are received, attached, and made a part hereof as Exhibit "A"; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND. ORDER AS FOLLOWS-:- _ - - Attachment 1 SECTION 1. That the whole number of ballots cast in the precincts, except vote - by -mail ballots was 16,058; that the whole number of vote -by -mail ballots cast in the City, was 13,758; making a total of 29,816 ballots cast in the City SECTION 2. That the names of persons voted for at the election for Member of the City Council are as follows: JIM RIGHEIMER, WENDY LEECE, SUE LESTER, CHAD W. PETSCHL, AND CHRIS MCEVOY; and That the question for Measure L considered by the electorate was as follows: YES Shall the City increase the existing Transient Occupancy Tax from 6% to 8%, which tax is, and will continue to be, imposed only on NO transients occupying hotels and motels within the City, for the funding of general city services and programs? SECTION 3. That the number of votes given at each precinct, the number of votes given in the City to each above-named candidate for Member of the City Council, and for and against Measure L were as listed in Exhibit "A" attached hereto. SECTION 4. The City Council does hereby declare and determine that JIM RIGHEIMER and WENDY LEECE were elected as Members of the City Council for the full term of four years; and Attachment 1 That as a result of the election, a majority of the voters voting on Measure L relating to an increase in the Transient Occupancy Tax (TOT) to 8 percent did vote in favor of it and that the measure carried and Ordinance No. 10-18 shall be deemed adopted and ratified. SECTION 5. The City Clerk shall enter into the records of the City Council of the City, a statement of the results of the election showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) The Measure voted upon; (4) .The office for which each person was voted for; (5) The number of votes given at each precinct to each person and for and against the measure; (6) The total number of votes given to each person and. for and against the measure. SECTION 6. The City Clerk shall immediately make and deliver to each of the persons so elected, a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected, the Oath of Office prescribed in the Constitution of the State of California, and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall be inducted into the respective office to which they have been elected. SECTION 7: The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED AND ADOPTED this 7th day of December, 2010. WHEREAS, the electors of the City of Costa Mesa at a regular municipal election on November 2, 2010, approved a City Measure to increase the City's Transient Occupancy tax from six percent (6%) to eight percent (8%). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 16-68 of Title 16 (Taxation), of Chapter IV (Transient Occupancy Tax) of the Costa Mesa Municipal Code is hereby repealed and replaced in its entirety with the following: Section 16-68 - Tax imposed; nature; payment. For the privilege of occupancy in any hotel or motel, each transient is subject to and shall pay a tax in the amount of eight percent of the rent charged by the operator. The tax constitutes a debt owed by the transient to the city which is extinguished only by payment to the operator or to the city. The transient shall pay the tax to the operator of the hotel or motel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient's ceasing to occupy space in the hotel or motel. If for.any reason the tax due is not paid to the operator of the hotel or motel, the finance department may require that the tax shall be paid directly to the finance department. Section 2. In all other respects, the existing Transient Occupancy Tax, 'including the method of collection shall remain the same as currently provided in Attachment 2 Title 16 (Taxation), Chapter IV (Transient Occupancy Tax) of the Costa Mesa Municipal Code. Section 3. Any provision of the Costa Mesa Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to. that extent necessary to effect the provisions of this Ordinance. Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Costa Mesa hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. Section 5. Any legal action to challenge, test, or otherwise determine the validity of this ordinance, or any portion thereof and the tax imposed thereby must be brought within sixty days of the effective date of this ordinance, in accordance with the provisions of California Code of Civil Procedure Section 860 et seq., and Sections 860 and 863 in particular. Section 6. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published and posted pursuant to the provisions of law in that regard and this Ordinance shall take effect 30 days after its final passage.
