Appoint members to the Planning Commission and/or the Parks and Recreation
Commission.
BACKGROUND:
At their December 7, 2010 meeting, City Council directed staff to initiate recruitment for
both Planning and Parks and Recreation Commissions in order to allow anyone
interested in serving on either Commission to apply, including current members of one
Commission who may be interested in serving on the other Commission.
DISCUSSION:
A total of 28 applicants have submitted Commission interest forms or letters of interest in
response to the City's November 17th and December 3rd, 2010 press release recruitment
announcements. The current rosters of both Commissions and the applications are
included as Attachment 1. The Planning Commission is scheduled for three appointments
including the former seat vacated by Mayor Pro Tem Righeimer. The Parks and
Recreation Commission is scheduled for three appointments. The number of
appointments needed may change if the vacant City Council seat is filled by a current
commissioner. Eight applicants have requested to serve on either Commission. An
asterisk next to an applicant's name identifies the first choice Commission preference for
that individual.
The following lists the applicants for the Planning Commission, followed by those who
submitted applications to serve on the Parks and Recreation Commission (in
alphabetical order):

Although Council directed staff to move forward with appointments at the January 4, 2011
meeting, staff wanted to make mention that pursuant to City Council Policy 000-2.5
(Attachment 2), Commission appointments are to be made at the 2nd meeting in January
after a Council election. Also pursuant to City Council Policy 000-2.5, it has been
confirmed that all applicants are Costa Mesa residents and are registered to vote.
APPOINTMENT PROCESS:
Steps:
1. The City Clerk announces the time and place for appointment of
Commissioners and reads into the record the names of all applicants.
2. The Mayor opens the floor for public comments.
3. Following Public Comments, members of the City Council may provide
comments on applicants, qualifications and related matters.
4. Council members draw numbers to determine order of nominations.
5. The first Council member in order nominates their preferred applicant. The
nomination must receive a second to be voted upon. Upon receiving a second
to the nomination, the Mayor calls for the vote. In the event a nomination does
not receive a second, the right to nominate moves to the next Council
member in order of the draw.
6. The process of nominations and seconds continues until Commission
vacancies are filled.

ALTERNATIVES CONSIDERED:
City Council could choose not to make appointments. The Council could choose to
further discuss changing the structure of the two commissions. Attached is a prior staff
report where the City Council considered combining the two commissions (Attachment
3). If this concept is to be considered further, the Council would need to direct staff to
review the municipal code and present proposed code modifications that would legally
allow for structural changes to the commissions.

CONCLUSION:
Staff has provided this report identifying the applicants who wish to serve on the Planning
Commission and/or the Parks and Recreation Commission, and summarizing the
Commission appointment process. At this time, City Council is requested to make
appointments on both the City's Planning Commission and Parks and Recreation
Commission and appoint an applicant to fill the unexpired term on Planning Commission
and or Parks and Recreation Commission if needed. The terms are to expire as noted in
Council Policy 000-2.5.

COMMISSION: Planning Commission
MEETING SCHEDULE: The Commission meets on the 2nd Monday of the month at
6:00 p.m.
REPRESENTATION: Representation is comprised of five Costa Mesa residents.
PURPOSE: The City Planning Commission derives its power from the
provisions of the California Government Code. The
Planning Commission has the power, by law, to act upon or
recommend to the City Council: 1) the regulation of future
growth, development, and beautification of the City in
respect to its public and private works; 2) consistency with
municipal plans to ensure that future growth and
development do not impede upon sanitation, public utilities,
and transportation facilities; 3) the location of any proposed
buildings, structures or works; and, 4) the design and
improvement of proposed subdivisions of the land. The
Planning Commission also hears appeals from decisions of
the Transportation Services Engineer on matters dealing
with parking restrictions, traffic - control devices and
transportation improvements.
GOALS AND OBJECTIVES:
Continued implementation of the following Planning Commission Objectives
adopted in May 2000:
1. To review and take action, or recommend action to the City Council, on land use
development proposals based on General Plan and Zoning Code compliance.
2. To make recommendations to the City Council on Zoning Code amendments, land
use policy, and adoption of environmental documents.
3. To administer a Planning Commission award program which recognizes excellence
in community planning, architecture, and green building design.
4. To serve as a review authority for appeals of the Zoning Administrator's decisions.

COMMISSION: Parks and Recreation Commission
REPRESENTATION: Five residents of the City of Costa Mesa.
PURPOSE: This Commission was created to assist the City Council
and various City departments with issues relating to Parks
and Parkways.
MEETING SCHEDULE: Fourth Wednesday on every odd month. Agenda

♦ Review and approve recreation program related fees.
♦ Review and recommend Recreation Cost Recovery Program.

♦ Make determination on all Tree Removal Requests in accordance with the City's
"Streetscape and Median Development Standards".
♦ Review and recommend revisions to the Streetscape and Median Development

I think it is a privilege to sense the community of the City of Costa Mesa. I watched my grandfather
serve my community growing up, focusing on quality of life issues as a Town Selectman. My Mother
senses on her local Housing Authority focusing efforts on quality of life of the seniors. As kids, we
volunteered as a family providing some of the best memories around civic responsibilities. You could
say my passion for community service is genetic.

Commission:
I am a current Planning Commissioner, asking to be reappointed to the Planning Commission.
I brought with me the experience of having a family with young children, owning a home, starting a
small business. I have experience as an international business executive with a track record of
achievement handling complex, large ticket, long cycle business deals. As a small business owner, I
introduced a new concept to market that had all kinds of land use requirements. This gave me the
relevant experience of dealing with Planning Departments throughout the region and provides me
perspective that I have applied to Planning Commission Decisions.
I continue to gain experience and have improved as a Planning Commissioner. I have continued to
educate myself, as an example I invested time to become a Certified Green wilding Professional. I
have worked well with my fellow Commissioners, City Staff, Council Members and the community to
accomplish efficient results and to influence green and sustainable outcomes. As an example, the
community made it clear to the Planning Commission that improved enforcement of Title 20 — Code
Enforcement was a priority. I worked with the community, with Staff, and fellow Commissioners to vet
and package a recommendation approved by City Council.

appointment to the City's Parks and Recreation Commission (my preference) or the Planning

As an urban planner and environmental consultant based in Costa Mesa, I have over 13 years of
experience working with the private sector and government agencies on land use planning and
environmental policy issues. Specifically, l have cultivated a practice focusing on sustainable
development and green building, community planning, large-scale recreational and open space
planning, and environmental policy development and analysis. Trained as an attorney and
environmental designer, I have a keen understanding of how to meet regulatory requirements and

From comprehensive citywide plans to regional park plans to infill development sites, I operate at
various scales and know how the planning and development processes intersect. Previously I served
as the planning director for the Baldwin Hills Conservancy, a state agency charged with planning,
developing, and programming a 1,400 -acre park in the heart of Los Angeles. I also spent three
years as the Deputy for District and Environmental Policy for a Los Angeles City Councilmember,
where I managed community planning projects, drafted legislation, and evaluated development
proposals. Having worked for elected officials and government agencies, 1 have an intimate
comprehension of public administration, the regulatory arena, and the political process,
As a resident of Costa Mesa I have served on city committees charged with planning and improving
our built and natural resources. In 2006, 1 was appointed to the City's Santa Ana River Trail Blue
Ribbon Task Force, which produced a vision strategy for enhancing the river corridor as a key
component of our parks and recreation system. More recently, [ was a member of the Brentwood
Park Task Force, which advised the City in the conceptual master planning for the expansion of my

As a father of three young children and long-term resident of Costa Mesa, I feel I owe a debt of gratitude to the city that I
have grown to call home. Costa Mesa offers a wide range of activities and neighborhoods for young families such as
mine. This feeling of pride for our city has caused me to look for ways to improve our city, while retaining its warmth and
charm. As a former Rotarian, I am constantly looking for ways to reach outto the community through programs such as
Arbor Day tree plantings, Coastal Costal Clean Up with the County, to honoring outstanding students. This experience

an active volunteer with AYSO region 97, my children's school, and my church. As the Community Services Chair for a

I am interested in serving the community and would like to be considered for a position on the Planning
Commission. As a resident and business owner in Costa Mesa I am very interested in the welfare of our
residents and businesses. I know many of the challenges facing both of these groups as well as the
challenges facing our city in these difficult economic times. I have attended all of the city council
meetings since my business opened at the end of last year and have attended some planning
commission meetings as well.
Our city must generate additional revenue to avoid further cuts of necessary city personnel and services.
The planning commission plays an integral role in the future of our city's residents and businesses and
the quality of life in Costa Mesa overall. Being on the Planning Commission would allow me to assist in
this process not only short term but long term. I would like to help our current businesses to succeed
and help to attract a variety of new businesses that would complement the businesses we already have
available here. Working together with different types of people with different interests toward a
common goal that will benefit our community is something I truly want the opportunity to do and I have
the time to do it.
I would also [Ike to work with the other planning commissioners on improving our streets and roads,
Very little funds have been made available for much needed improvements throughout the city, I am
interested in keeping our neighborhoods beautiful, safe and in good condition. I would like the
opportunity to work with planning and the council to find new and creative ways to free up funds so our
infrastructure issues can be addressed. The revitalization of the West Side as well as the homelessness
issues occurring in the city are also of great concern/interest to me. I know I can contribute to solutions
and am willing to put the time needed to achieve the goals of the city.
I believe my work and life experience would be beneficial to the Planning Commission, our residents,
and our current and potential new businesses. I worked for ten plus years in loss prevention and
operational systems management for one of the nation's leading retailers best known for its customer
service. Part of my time was spent working at South Coast Plaza, the nation's highest revenue
generating mall. I have many years of Human Resource and Risk Management experience. Part of my
responsibilities included working with OSHA, the fire marshal and other regulatory agencies. I am well
versed in conflict resolution and dealing with people, all kinds of people. I am fair and have the ability to
deliver a message that isn't always favorable yet achieve a favorable outcome. I continually push myself
to learn more so I can continue to be effective in my business and personal life,
believe my experience as a business owner in this city would be a valuable asset to the commission as
well as to the applicants that come before the commission. I will be able to see the situation from both
sides. I am prepared to act on behalf of what is best for Costa Mesa overall while helping our businesses
and protecting our residents. i will not abandon the interests and quality of life of our residents to
benefit big business but believe I would be effective in working toward resolutions that will serve all

As a resident of Costa Mesa since 1985, 1 have had the opportunity to observe the changes and unique
improvements to our City for many years. There is still work to be done and I would be honored by the
opportunity to continue to serve. Since 20061 have volunteered my time in public service with
dedication and integrity. I am presently a Parks and Recreation Commissioner for the City, as well as an
active member of two of our City Committees: Historic Preservation and 3R.
I believe that in order for any city or municipality to grow, improve, and better serve its citizens there

As an eight year resident of Costa Mesa and a recent homeowner who plans to live here for some time to come, I want
to make sure the future of our great city is in good hands. I have lived in many of the various neighborhoods around the
city including the Westside, Eastside, Mesa Verde & Halecrest. I know the issues in all areas of the city, not just the
neighborhood I currently reside.
Also, as a certified Real Estate agent and the owner of a Real Estate Acquisition firm, I am very well versed in the
various issues that come with the territory of being a Planning Commissioner. I have followed in detail the Planning

The role of a Planning Commissioner is quite complex in scope and nature. However, a great portion of the matters that
come before the Commission have their roots in Real Estate and the important issues that go along with building and
design location as well as improvement and use of private property in our city.
In my former position, I assisted with the design and development of Commercial projects throughout the Western U.S.,
and have a deep knowledge of commercial projects and design. This knowledge, combined with my familiarity of the
various areas of the city, would make me the ideal Planning Commissioner. Also, my role as owner of a Real Estate

I work as a project manager for a company that coordinates local per for new and modified cell phone sites. Over
the past 5 years I've worked with over 30 local jurisdictions, including many cities, and in the process I have learned a
lot about how city government works. I've used this experience to present nearly 100 projects to different planning
commissions around California and Nevada. In doing this I have worked closely with both planning and building
departments, which ultimately approved every single project that I have presented. I am knowledgeable about the
different planning and building requirements that are needed for different projects, and I've worked closely with
architects and engineers to provide jurisdictions with designs and modification that worked well aesthetically and
functionally. This experience has shown me many of the problems that have delayed and or killed projects, and taught
me to how to put together innovative solutions. I have also managed several construction crews, which has helped
familiarize me with many construction materials including some really exciting green building materials. I am a very
motivated individual with a keen interest in enhancing the City of Costa Mesa's reputation and functionality. I've

Parks and recreational programs are important quality of life amenities for city residents. Costa Mesa, through planning
and design, has wonderful facilities that that are a boon to our community. In times of budget crisis and cuts preserving
these facilities requires diligence and expertise from managers, committees, supervisors and employees . I'm
interested in contributing my time and skills working with others towards protecting and optimizing our recreational
facilities and ensuring a fair and equitable distribution of our resources and programs.
Having raised two boys in Costa Mesa I have been a client of Costa Mesa Parks and Recreation for more than a
decade. Our family deeply appreciates the fields and parks we played on as teams and as a family throughout the city.
These amenities were important when we made the decision to move to our fair city and have improved our quality of
life. My experience with Parks and Recreation goes way back. As a teenager I worked for my hometown recreation

I think the Parks and Recreation Commission needs to remain its own entity especially with the current and future
challenges we now face due to the economy and budgets. The current commission will end the year of 2010 having
made great strides moving in a positive direction. I want to keep that motion moving and aid in making Costa Mesa the
best city in the county.
If the Parks and Recreation Commission and Planning Commission are merged, I would like consideration for the
Planning Commission, I have also applied for the Planning Commission in anticipation of such a decision. If the
commissions are merged, the new commission needs to have someone versed in the parks and recreation system.

This opportunity has given me an insight as to how the city's parks and recreation system works. Meeting and working
with city staff has provide an experience of working'within the municipal guidelines.
Some accomplishments during my four year tenure:
Initiated commissioner park tours, resulting in open, one on one communication with the public. Provided an opportunity
for public input regarding the placement of "pocket skate parks" within neighborhood parks.

To Distinguished City Council Members,
A passion for my community is the driving force behind my desire to continue
representing the City of Costa Mesa as a Parks and Recreation Commissioner, I ask for
your nomination and support to continue my work on the many important issues that
face our commission today.
Today, Lions Park is faced with very important decisions to investigate how best to
handle the needs of the community to keep this city asset safe and one that a family
can be proud of. The many problems associated with this park can no longer be
ignored. In your appointment to the Parks and Recreation Commission, I will ask to be
appointed to the Lions Park Task Force to take on a proactive role in returning this park
to the family park it was intended to be.
In addition to Lions Park, other important issues facing the city are; how do we save
ROCKS while balancing the budget. One suggestion I have been working on with city
staff is to convert the program to a pay per use program. We have looked at being able
to provide services to many of the schools that have lost this program. I hope to be able
to present to the Parks and Recreation Commission and ultimately City Council, a self
sufficient program that continues to keep kids off the streets and provides enough cash
flow to pay for itself. With the amount of research I have done, I believe this is
something we can accomplish. Other issues include our many challenges in the Joint
Use Agreement with the Newport Mesa School District.
When you look at my professional experience as a real estate broker and company
owner, I am in the trenches of Costa Mesa every day. I often tell prospective clients that
they should work with me because I know each and everything there is to know about
Costa Mesa and why they should live here. This is the same reason I believe you as a
City Council Member should appoint me. I live in Costa Mesa, work in Costa Mesa, and
Play in Costa Mesa. I have been an active member of the Parks and Recreation
Commission making many important and difficult decisions. I have served on many
important task forces including the Costa Mesa High School and Tewinkie Sports Fields
remodel. I have served as the Newport Mesa liason. I sit on the board of the Costa
Mesa Youth Sports Council as well as Costa Mesa United. I have and expert level of
understand of sports in our city, the needs of the groups, fields, and how we will
continue to provide for our sports community with the many challenges of doing more
with less fields.
It is with all these real world experiences that have given me the passion and desire to
work for the community I love so much. I will continue to be an active member of my
community and ask for your support in appointing me to continue the work I have
begun.

I am a 14 year resident of Costa Mesa and a parent of three boys who attend
Davis Magnet Elementary School. I met Kurt Galitski, at Davis, in the spring of 2010
when it became apparent that ROCKS program might lose funding due to budget cuts. He
approached me and asked if the PTA would help support him in the upcoming
"Swingathon" to help raise money to save ROCKS. He worked closely with the PTA to
provide support and information to the parents at Davis Elementary. As parents of
children Avho attended a Costa Mesa school, we both had a vested interest in ivanting to
save an after school program that was deeply valued by many parents and children at
local schools.
It was then that I saw Kurt's commitment to our community. He was one of the
main people that dedicated his time to not only being the only person swinging at Davis,
but making himself available to help out in anyway needed to raise awareness of the
potential loss of the ROCKS program. Kurt played a key role in helping to motivate and
support efforts in working to save the Davis ROCKS Program for 2010-2011 school year.
Kurt was willing to donate his personal time to help support a program that was valued
by the residents of the city of Costa Mesa. I truly feel that Kurt is a good candidate for a
seat on the Costa Mesa Parks and Recreation Commission. He holds strong ties to the city
of Costa Mesa on both a personal and business level. He is very passionate about helping
to build a city that is a strong community working together to provide a safe and
welcoming environment to all of its residents.

appointment to the City's Parks and Recreation Commission (my preference) or the Planning
Commission.
As an urban planner and environmental consultant based in Costa Mesa, I have over 13 years of
experience working with the private sector and government agencies on land use planning and
environmental policy issues. Specifically, I have cultivated a practice focusing on sustainable
development and green building, community planning, large-scale recreational and open space
planning, and environmental policy development and analysis. Trained as an attorney and
environmental designer, I have a keen understanding of how to meet regulatory requirements and
program goals with creative land use and design strategies.
From comprehensive citywide plans to regional park plans to infill development sites, I operate at
various scales and know how the planning and development processes intersect. Previously I served
as the planning director for the Baldwin Hills Conservancy, a state agency charged with planning,
developing, and programming a 1,400 -acre park in the heart of Los Angeles. I also spent three
years as the Deputy for District and Environmental Policy for a Los Angeles City Councilmember,
where I managed community planning projects, drafted legislation, and evaluated development
proposals. Having worked for elected officials and government agencies, I have an intimate
comprehension of public administration, the regulatory arena, and the political process.
As a resident of Costa Mesa I have served on city committees charged with planning and improving
our built and natural resources. In 2006, 1 was appointed to the City's Santa Ana River Trail Blue
Ribbon Task Force, which produced a vision strategy for enhancing the river corridor as a key
component of our parks and recreation system. More recently, I was a member of the Brentwood
Park Task Force, which advised the City in the conceptual master planning for the expansion of.my
neighborhood park, And through my position as a Board member of the Costa Mesa Community
Foundation I have been an advocate for directly investing in our neighborhoods and park system. I
am also a current member of the City's Cultural Arts Commission and the 3R Committee.
More important than my experience and expertise, though, is my vested interest in ensuring that
Costa Mesa grows as a prosperous and dynamic community. I would greatly appreciate the

industry, education and parks. Given all the city offers to Its residents as well as visitors, we need people who can look
at the big picture and how small actions can create big results. As the owner of a Supply Chain consulting firm, I show

been active in my neighborhood association (Mesa North Community
Association) for more than 10 years and now I would like to contribute my

I have served in various capacities in the Mesa North Community Association,
my neighborhood association as Director, Treasurer, and newsletter publisher.
This has given me insights into our City organization. For example, in 2005 and
2006, groups from outside our city were taking over Paularino Park on the
weekends and using it for their games of succor, These were not children, but
young adults. They told residents entering the park to leave, as "they were using
it." A group of us from the association began working with the Parks department
for a solution. Thanks to the Park and Recreation Department staff, particularly
Jana Ransom, the City Council
declared the park a passive park on July 17, 2007. Subsequently, park
improvements were made which greatly enhanced the beauty of the park as well
as discouraged organized team sports. The park continues to today as a popular
recreation spot for the entire neighborhood.
I am a CPA by experience and training. I understand budget constraints and the
merits of good planning. I think these skills can be useful to the organization.

As an eight year resident of Costa Mesa and a recent homeowner who plans to live here for some time to come, I want
to make sure the future of our great city is in good hands. I have lived in many of the various neighborhoods around the
city including the Westside, Eastside, Mesa Verde & Halecrest. I know the issues in all areas of the city; not just the
neighborhood I currently reside. .
First and foremost, we must remember that our commitment to the residents of Costa Mesa is our main priority. Our
fields and facilities will always be in high demand by groups from inside and outside our city, and it is up to the Parks &
Recreation Commission to make sure the facilities are kept in top condition for our residents first.
Also, as a resident of the Halecrest neighborhood, I have seen how important trees are to maintaining property values.
As a former resident of Mesa Verde, I directly saw how that neighborhood took pride in its tree -fined streets. Halecrest
has gone the opposite direction over the years, and I would like to reverse that trend with 1,000 new trees throughout
the city in my first year as a Parks & Recreation Commissioner.

As a sports enthusiast, I have directly been a part of the many recreational facilities and programs in our city. I am
currently enrolled in the Costa Mesa Adult Basketball league and have been for many years. I have also participated in

I've been a resident of Costa Mesa all my life (other than my college years). I've always been interested in helping the
City improve through public senrice. I grew up right next to Fairview Park and enjoyed Flying remote controlled planes
and running in the area. Open space is important to me, it needs to be accessible and functional for public use and

BACKGROUND
The City Council has changed the method it uses to appoint the members of the Planning
Commission and the Parks and Recreation Commission so that appointments to each of
these commissions is by majority vote. The persons appointed serve at the pleasure of the
City Council. The commissioners' terms are for four years except that initial appointments
under Ordinance number 04-17 for two of the Planning Commissioners and two of the Parks
and Recreation Commissioners, chosen randomly, shall be for two years in order to have
staggered terms.
PURPOSE
To establish certain procedures governing the appointment of Planning and Parks and
Recreation commissioners and related matters.
PRACTICES AND PROCEDURES
1. Appointments
a. The City Manager will put on the City Council agenda for the second regular City
Council meeting in January following each General Election the matter of
appointment of commissioners for the Planning Commission and Parks and
Recreation Commission. Appointments will be needed to fill any vacancies caused
by the expiration of commission member terms.
b. The City Manager will give advance notice of the calendaring of this matter to the
Council Members.
c. Prior to the scheduled Council meeting, the City Manager will also cause public
notice to be given of the number and type of commission appointments to be
made and invite any interested persons to submit to his office their name, resume,
and statement of interest in the commission appointment desired. All such
applications received will be supplied to the Council Members.
d. At the scheduled Council meeting when this matter is called for consideration,
each Council Member may make nominations of persons to be appointed to each
commission to be voted on by the entire council.

2. Qualifications
a. Commissioners must be residents and qualified electors of the City. The City Clerk
shall verify that applicants satisfy these qualifications.
b. No commissioner shall be a regular, full-time employee of the City, nor a Council
Member.
c. The Council Members shall select their nominee(s) based on the individual Council
Member's judgment that his or her nominee(s) are the best qualified persons for
these commissions.
d. The appointments shall be from among persons who have submitted
applications.
3. Terms
a. Each commissioner will serve a term of four years except that upon initial
appointment following adoption of this Policy Revision and Ordinance Number 04-
17, two members of each commission, selected at random, shall serve a term of
two years.
b. Notwithstanding subdivision 3.a above, a commissioner will continue to serve until
a replacement commissioner has been appointed and qualified.
c. A commissioner's term shall automatically terminate upon his or her ceasing to be
qualified under section 2 above.
4. Removal
a. A Council Member may request consideration of removal of a Commissioner by
placing the removal on a Council agenda.
b. When this matter is called for consideration, The City Council may remove any
member of either commission by majority vote.

Compensation for the commissioners will be set from time to time by City Council
resolution.
6. Absences
The provisions in Costa Mesa Municipal Code, section 13-10(d) and (e) describing
excusable absences and absences resulting in termination of office shall govern both
Planning and Parks and Recreation commissioners. An absence without cause from
three consecutive meetings shall automatically end a commissioner's term of office.
7. Additional Policies
Except as provided in this policy, the Planning Commission and Parks and Recreation
Commission shall be guided by the policies set forth in the
Commissions/Committees/Boards Handbook. In case of any inconsistencies between
this policy and the Handbook, the provisions in this policy shall govern these

DISCUSSION:
At the September 1, 2009 regular meeting, the City Council provided direction on filling
the recently created vacancy on the Planning Commission as a result of Mr. Jim Fisler's
resignation. The City Council included in the motion the prospective consideration of
the consolidation of the Planning Commission and the Parks & Recreation Commission.
Although staff was not requested to prepare a report for consideration of this subject,
there are some facts that may be of benefit to the City Council in its deliberations.
Both the Planning Commission and the Parks & Recreation Commission are
established by code with specific responsibilities assigned to each.
The Planning Commission is established under Title 13 of the municipal code involving
Planning, Zoning and Development. The authorities of the Commission are set forth in
Section 13-10 et seq. of the code as they pertain to land use regulation, short and long
range planning, beautification, code enforcement, infrastructure and related issues. A
copy of the Planning Commission's specific authorities is attached as Attachment 1.
The Parks & Recreation Commission is established under Title 12 of the municipal
code. The authorities of the Commission are set forth in Section 12-71 et seq. of the
code relating to park & open space acquisition and development, recreational
programming including the establishment of program fees, parkways and final authority
over parkway tree removals. A copy of the Parks & recreation Commission's specific
authorities is attached as Attachment 2.
Based on currently assigned responsibilities, there is very little jurisdictional overlap
between the two commissions. The only area where there is some potential overlap
involves the Park & Recreation Commission's annual review of projects submitted for
consideration in the City's annual Capital Improvement Project (CIP) budget and the
Planning Commission's review of the CIP for consistency with the City's adopted
General Plan. Beyond this, each commission has very specific, distinct responsibilities.
The decisions of each body are subject to appeal or review by the City Council with the

exception of the Parks & Recreation Commission's actions on parkway tree removal. If
consolidation of the commissions is authorized, staff will need to prepare under the
direction of the City Attorney a variety of ordinance changes to effectively consolidate
statutory authorities: For this reason, consolidation of the Commissions should be
considered prospective to allow sufficient time for preparation of the ordinance
changes, public hearings and final consideration.
From a budgetary perspective, each commission has undergone significant cost
reductions during the current fiscal year. The Planning Commission budget was
reduced from $31,500 in FY 2008-09 to $24,600 for FY 2009-10. Likewise, the Parks &
Recreation Commission budget was reduced from $8,830 in FY 2008-09 to $5,100 in
FY 2009-10. With the exception of clerical support for the taking of minutes and
correspondence, staffing for each commission is provided by management personnel
with no additional cost. Consequently, there will be no change in the cost of staff
support at the meetings although staffing may change somewhat if the commissions
are consolidated. Considering costs, excluding Board members fees (compensation
provided to Commissioners), total savings would be less than $3,500 annually. Costs
related to public noticing and cable casting of meetings has not been included in the
above on the presumption that these would occur irrespective of the number of
commissions.

PLANNING, ZONING AND DEVELOPMENT
Zoning Code amendments, improvement and de-
velopment agreements, annexations and any ac-
tion specified in this Zoning Code. The city council
shall also be responsible for the acceptance of
lands and/or improvements as may be proposed
for dedication to the city, except deeds of dedica-
tion and parcel maps of four (4) or fewer lots with
no development agreements. The city council may
impose conditions of approval.

Sec. 13-9. Redevelopment agency.
(a) Declaration of need of agency. It is hereby
found and declared, pursuant to State Health and
Safety Code Section 33101, that there is a need
for a redevelopment agency in the city, as such
agency was created by Section 33100, to function
in the city, and the agency is hereby authorized to
transact business and exercise all of the powers
granted to it under the Community Redevelop-
ment Law.
(b) Council declared agency. The five (5) mem-
bers of the city council are hereby declared to be
the members of the redevelopment agency and
are empowered to exercise all the rights, powers,
duties, privileges and immunities vested by the
Community Redevelopment Law in an agency.
(c) Term of agency members. Membership shall
be for the period each councilmember serves in
office, and shall automatically terminate at the
time any councilmember no longer holds the office
of councilmember. Any vacancy existing on the
redevelopment agency shall be filled only by a
duly elected sworn and acting city councilmember.

Sec. 13-10. Planning commission.
(a) Commission created. Pursuant to the pro-
visions of Section 65101 of the Planning and
Zoning Law of the State Government Code, there
is hereby created a planning commission which
shall consist of five (5) members.
(b) Appointment of commission. The planning
commissioners shall be appointed and may be
removed, by a majority vote of le entire city
council. Additional details for the appointment
procedures and member qualifications, terms and
compensation may be set by city council policy.
(c) Ex -officio member of commission. The city
engineer and city attorney or his/her designee
shall attend the meetings of the planning commis-
sion and assist the commission in an advisory
capacity as needed.
(d) Absence from commission meetings without
cause. If a planning commission member is absent
from three (3) consecutive regular meetings of the
commission, without cause, the office of the mem-
ber shall be deemed to be vacant and the term of

such member terminated. The secretary of the
Planning commission shall immediately inform
the city council of such termination.
(e) Absence from commission meetings for cause.
An absence due to illness or an unavoidable
absence from the city and written notice thereof
given to the secretary of the planning commission
on or before the day of any regular meeting of the
commission shall be deemed absence for cause.
(f) Councilmember ineligibility. No legislative
body member of the city shall be eligible for
membership on the planning commission.
(g) Authority of the planning commission.,
(1) The planning commission shall have the
power, except as otherwise provided by
law, to act on plans for the regulation of
the future growth, development and beau-
tification of the city, in respect to:
a. Public and private buildings and
works, streets, parks, grounds and
vacant lots.
b. The future growth and development
of the city in order to secure sanita-
tion, proper service of all public util-
ities, shipping and transportation fa-
cilities.
C. The location of any proposed build-
ings, structures, or works.
(2) The planning commission is authorized to
act upon the following discretionary ac-
tions:
a. Recommend to the city council ap-
proval, conditional approval or de-
nial of general plan amendments,
specific plans, rezones, Zoning Code
amendments, development agree-
ments, density bonuses with public
financial incentives, preliminary and
final master plans, and any other
action specified in this Zoning Code.
b. Recommend to the redevelopment
agency approval, conditional approval
or denial of redevelopment actions,
or adoption and/or amendments to a
redevelopment plan.
C. Approve, conditionally approve or
deny applications for conditional use
permits, variances, tentative tract
and parcel maps, density bonuses
without public financial incentives,
and any other action specified in this
Zoning Code.
d. Perform other duties necessary to
carry out the provisions reserved to
the planning commission in Title 10
of the Municipal Code, the provi-
sions of this Zoning Code and the

provisions of the Planning, Zoning ARTICLE 4. ENFORCEMENT
and Development Law of the State
Government Code. Sec. 13-13. Purpose.
(h) Commission bylaws authorized. The plan-
ning commission shall have the power, except as
otherwise provided by law, to adopt such bylaws
as it may deem necessary to provide for:
(1) The time and place of meeting.
(2) The time and method of electing officers.
(3) Such other matters relative to the orgam-
zation of the planning commission and
methods of administration of its duties
which are not otherwise provided for by
statute or ordinance.
(i) Regular meeting of commission defined. A
regular meeting as provided by law or by rule of
the planning commission or any regularly adver-
tised public hearing shall be deemed a regular
meeting.

Sec. 13-11. Zoning administrator.
(a) The development services director or his/
her designee is authorized to act as the zoning
administrator according to procedures set forth in
the State Government Code.
(b) The zoning administrator is authorized to
approve, conditionally approve, or deny the fol-
lowing discretionary planning applications. The
zoning administrator may forward any action to
the planning commission for review.
(1) Administrative adjustment;
(2) Minor conditional use permit;
(3) Lot line adjustment; and
(4) Any action specified in this Zoning Code.

Sec. 13-12. Planning division.
The development services director or his/her
designees constitute the planning division. The
planning division is authorized to act on and
grant approvals of development reviews and mi-
nor modifications as described in Chapter III,
Planning Applications, and other duties as desig-
nated by the development services director, plan-
ning commission, city council and this Zoning
Code.

Sec. 13-14. Enforcement officer designated.
The development services director or his duly
authorized representative is hereby empowered
and it shall be his/her duty to enforce all provi-
sions of this Zoning Code.

Sec. 13-15. Duties.
All departments, officials and public employees
of the city invested with the duty or authority to
issue permits or licenses shall conform to the
provisions of this Zoning Code and shall issue no
permit or license for uses, buildings or purposes
in conflict with the provisions of this code; and
any such permit or licenses issued in conflict with
the provisions of this Zoning Code shall be null
and void. It shall be the duty of the development
services director to enforce the provisions of this
Zoning Code pertaining to the creation, construc-
tion, reconstruction, moving, conversion, alter-
ation or addition to any building or structure.

Sec. 13-16. Enforcement.
(a) Criminal prosecution. Any person, whether
as principal, agent, or employee, violating the
terms of this Zoning Code may be prosecuted as
provided in section 1-33 of this Municipal Code.
(b) Criminal citation. For the purposes of this
Zoning Code, a violation of the terms of this
Zoning Code may be cited as either an infraction
or misdemeanor pursuant to State Government
Code Sections 36900 and 36901 and as provided
in section 1-33 of this Municipal Code.
(c) Civil action. As an alternative to prosecu-
tion or citation, or as an additional action, the city
attorney may, at the request of the development
services director, institute an action in any court
of competent jurisdiction to restrain, enjoin, or
abate the condition(s) or activity(ies) found to be
in violation of the provisions of this Zoning Code.

Pilots shall only use radio -controlled
frequencies allowed by the Federal
Communications Commission.
(4) No person shall turn on a transmit-
ter until an unused frequency is ob-
tained.
(5) Pilots shall, before every model air-
craft flight, check battery voltage of
the batteries in the model aircraft
and the radio control device for the
model aircraft, and make sure that
the batteries have sufficient power
for the duration of the flight.
(6) Pilots shall pre-flight check all new
airplanes before they are flown.
(7) Pilots shall inspect their model air-
craft to ensure that they are in safe
flying condition.
(i) If a model aircraft lands on private prop-
erty, no person shall go onto that property
to retrieve the model aircraft unless that
person first obtains permission from the
resident or occupant to retrieve the model
aircraft. If permission to retrieve a model
aircraft is refused, then the pilot shall
contact the Costa Mesa Police Depart -
went and request assistance in obtaining
the return of the model aircraft.
(j) Pilots shall not engage in combat flying at
the park.
(k) Pilots shall be responsible for any prop-
erty damage or personal injury caused by
the flying of their model aircrafts. In the
event such injury or damage occurs, the
pilot of the model aircraft shall provide,
upon request, his or her name, address,
telephone number and insurance informa-
tion to anyone who is injured or whose
property is damaged, including the city.

CHAPTER III. PARKS AND RECREATION
CONIlVIISSION
Sec. 12-71. Commission established.
There is hereby established as a part of the
government of the city, a parks and recreation
commission, which shall:
(a) Consider matters that may be referred to
it by the city council, the city manager,
the director of administrative services, or
the director of public services, and render
such counsel and advice in regard thereto
as may be requested by the referring
authorities;

(b) By its own motion, make such studies,
investigations and hold public hearings
as it may deem necessary for the formu-
lation of parks, recreation, recreation fa-
cilities and parkways policies, or to deter-
mine the wisdom and efficacy of the
policies, plans and procedures dealing with
parks, recreation, recreation facilities and
parkways matters, or to determine an
action program to pursue in implement-
ing the city open space plan and report its
findings and recommendations to the city
council, the city manager, the director of
administrative services, or the director of
public services;
(c) Recommend to the city council approval of
concept plans for development and/or mod-
ification of parks, recreation, and open
space facilities;
(d) Solicit to the fullest extent possible the
cooperation of school authorities and other
public and private agencies concerned with
the parks, recreation, recreation facilities
and parkways of the city;
(e) Make a determination on the necessity for
removal of parkway trees as provided in
section 15-11(2) of this Code, and the
necessity for terms and conditions for
retention of trees as provided in section
15-11(3)(c) of this Code, which decisions
shall be final not withstanding section
2-303;
(f) Set the fees to be paid by participants in
recreation programs and classes in accor-
dance with the guidelines adopted by the
city council in the Cost Recovery Program
for Recreation Activities;
(g) May review the annual budget as pre-
sented to the city council and advise them
on the current operational needs and long-
range plans for capital improvement;, and
(h) Periodically visit parks and recreation
facilities in the city to review established
programs and facilities, and to monitor
needs in accordance with the Parks, Rec-
reation and Open Space Master Plan.

Sec. 12-72. Rules and regulations.
The commission shall operate under the follow-
ing rules and regulations:
(a) Chairperson, vice -chairperson: The elec-
tion of the chairperson will precede that of
the vice -chairperson nominations. Elec-
tions of officers shall take place annually
to coincide as closely as possible with the
appointment terms of the commissioners.

PARKS AND RECREATION
The commission, in event of a vacancy in
either office, shall elect one (1) of its
members for the unexpired term.
(b) Meetings: The commission shall meet at
City Hall, 77 Fair Drive, on the times and
dates set forth by resolution of the city
council. In the event the regular meeting
day falls on a holiday, the regular meeting
shall be held on the next business day. A
regular or adjourned meeting may be ad-
journed to a time and place specified in
the order of adjournment. Special meet-
ings may be called at any time by the
chairperson, or in the absence of the chair-
person, by the vice -chairperson, by the
city manager, the mayor, or by the major-
ity of the members of the commission, by
notice delivered to each available member
of the commission, at least twenty-four
(24) hours previous to the meeting. A
regularly scheduled meeting may be can-
celled or rescheduled by a maj ority vote of
the commission, with proper notice as
required by law.
(c) Quorum: Amajority of the members of the
commission shall constitute a quorum for
the transaction of business. No action
shall be taken by the commission unless it
is concurred in and adopted by the affir-
mative vote of at -least a majority -of the
members present. The powers conferred
to the commission shall be exercised by
motion of resolution and recorded in the
minutes. Upon request of any member of
the commission a roll call of the vote shall
be conducted, and the results thereof re-
corded in the minutes.
(d) Secretary: The secretary shall be desig-
nated jointly by the director of public
services and the director of administra-
tive services. The secretary shall record
the minutes of the commission and shall
maintain the records of its proceedings
and transactions.

Sec. 12-73. Procedures.
(a) All meetings of the commission shall be

tions to the city council, the city manager, the
director of administrative services, or the director
of public services.
