Accept the work performed by American Asphalt, and authorize the City Clerk to file the Notice
of Completion.
2. Release the Labor and Material Bond seven (7) months after the filing date; release the
Faithful Performance Bond seven (7) months after the filing date; and release the retention
monies 35 days after the Notice of Completion filing date.
BACKGROUND:
On November 18, 2008 a construction contract in the amount of $4,295,449 was awarded to All American
Asphalt, Post Office Box 2229, Corona, California, 92878.
The scope of work included: landscaping and streetscape enhancements, including decorative sidewalks,
crosswalks, palm trees, planters and ornamental street lighting along the corridor; ADA compliant bus
stops, handicap ramps, and new bus shelters; construction of missing sidewalk along the west side of
Newport Boulevard, north of 17th Street; addition of a fourth northbound travel lane on Newport Boulevard
from 17th Street to north of 19th Street; addition of a fourth southbound travel lane on Newport Boulevard,
from the State Route 55 Freeway terminus to the intersection with Broadway; and addition of a
southbound right -turn lane at the intersection of Newport Boulevard and 17th Street. Following City
Council approval of change orders, staff implemented additional improvements in the Newport Boulevard
corridor, including additional decorative crosswalks, sidewalks, and side street reconstruction.

ANALYSIS:
The work required by the contract documents was completed on November 23, 2010, to the satisfaction
of the City Engineer. The final contract cost amounted to $5,311,160.69. A report of the final costs is
shown herein as Attachment "1 ".
A summary of the costs is as follows:
Original Contract Cost: $4,295,449.00
Change Orders & Adjustments $1,015,551.69
Final Contract Cost: $5,311,160.69
Change Order No. 1 revised the roadway surface material from conventional asphalt to a rubberized
asphalt concrete material for a net price increase of $227,999.22.
Change Orders No. 2 through 8 are contract management change orders to document changes in the
scope of work within Caltrans right-of-way required by changes in field conditions. These changes were
made to the concrete improvements, landscaping, irrigation, drainage and traffic signal items of work.
Change Order No. 9 was a credit of $347,965.91 to the project for adjustments in the original bid item
quantities.
Change Order No. 10 incorporated an additional $700,000 to the project by Council action on May 18,
2010. The Council -approved change order authorized the expenditure of the balance of the available
grant funding for the project to complete the eligible improvements, such as replacing all of the cross
walks with patterned and color added concrete walkways.
The final contract price reflects a 23.6 percent increase to the original contract as a result of the
aforementioned change orders.
As of this date, there are no Stop Notices filed against the monies due to All American Asphalt.
ALTERNATIVES CONSIDERED:
There were no alternatives considered for this item.
FISCAL REVIEW:
The project has received four separate grants totaling $6.2 million through State, Federal, and OCTA
funding awards.
LEGAL REVIEW:
There is no legal review required on this item.
CONCLUSION:
The Newport Boulevard Improvement Project - Federal Project No. RPSTPLE — 5312 (070), City Project
No. 08-08 has been completed. It is recommended that the City Council authorize staff to file the Notice
of Completion; release the remaining retention monies 35 days after the Notice of Completion filing date;
and release the bonds accordingly.
