1. Approve the attached resolution (Attachment 1) for the submittal of a grant application to the
Orange County Transportation Authority (OCTA) for the City's Tier 1 Water Quality Best
Management Practices (BMP) Installation Project.
2. Authorize the Department of Public Services Director as the City's representative.
BACKGROUND:
Competitive grant applications for the Environmental Cleanup, Tier 1 Grant Program are due on
April 18, 2011. Funding up to $2.8 million is available countywide with a maximum grant amount of
$100,000 per project. The funding for this program is provided to cities in Orange County by
OCTA's M2 Environmental Cleanup Program.
ANALYSIS:
The grant application to OCTA will request funding of $100,000 with the City matching the grant
with in-kind services of $50,000 for a total project cost of $150,000. The in-kind match consists
of staff time to manage the project, administer the grant, and maintenance of the project
improvements. Funding will be used for the purchase and installation of catch basin best
management practices (BMPs) throughout the city. Approximately 100 automatic retractable
screens and filters will be installed to collect litter and debris prior to it being deposited in the
waterway and ocean.
If grant funding is approved, project implementation can begin in July 2011. For the City to apply for
these grant funds, a resolution approving the filing of an application and naming the Public Services
Director as the City's authorized representative is needed.
ALTERNATIVES CONSIDERED:
If the Council chooses not to submit a grant application for this project, staff will continue to pursue
other grant programs and alternative funding.
FISCAL REVIEW:
No City cash match is required for this grant program.
LEGAL REVIEW:
The proposed resolution is approved as to form.
CONCLUSION:
It is recommended that the Council approve the filing of a grant application to the Orange
County Transportation Authority (OCTA) for the City's Tier 1 Water Quality Best Management
Practices (BMP) Installation Project and authorize the Public Services Director as the City's
representative.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
AUTHORIZING AN APPLICATION FOR FUNDS FOR THE ENVIRONMENTAL
CLEANUP, TIER 1 GRANT PROGRAM UNDER ORANGE COUNTY LOCAL
TRANSPORTATION ORDINANCE NO. 3 FOR THE TIER 1 WATER QUALITY
BMP INSTALLATION PROJECT
WHEREAS, Orange County Local Transportation Ordinance No.3, dated July
24, 2006, and is known and cited as the Renewed Measure M Transportation
Ordinance and Investment Plan makes funds available through the
Environmental Cleanup Program to help protect Orange County beaches and
waterways from transportation -generated pollution (urban runoff) and improve
overall water quality.
WHEREAS, the Environmental Cleanup, Tier 1 Grant Program consists of
funding purchases and installation to catch basins with Best Management
Practices, such as screens, filters, inserts, and other "street -scale" low flow
diversion projects.
WHEREAS, OCTA has,established the procedures and criteria for reviewing
proposals; and 0.
WHEREAS, the Public Services Department possesses authority to nominate
water quality improvement projects that have a transportation pollution nexus to
finance and construct the proposed project; and
WHEREAS, by formal action the Costa Mesa City Council authorizes the
nomination of the Tier 1 Water Quality BMP Installation Project, including all
understanding and assurances contained therein, and authorizes the Director of
Public Services to act in connection with the nomination and to provide such
additional information as may be required; and
WHEREAS, the Public Services Department will maintain and operate the
equipment acquired and installed; and
WHEREAS, the Public Services Department will give OCTA's representatives
access to and the right to examine all records, books, papers or documents
related to the funded Tier 1 Grant Project; and
WHEREAS, the Public Services Department will cause work on the project to
be commenced within a reasonable time after receipt of notification from OCTA
and that the project will be carried to completion with reasonable diligence; and
WHEREAS, the Public Services Department will comply where applicable with
provisions of the California Environmental Quality Act, the National
Environmental Policy Act, the American with Disabilities Act, and any other
federal, state, and/or local laws, rules and/or regulations;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Costa Mesa, hereby authorizes the Director of Public Services as the official
representative of the Public Services Department to apply for the Environmental
Cleanup, Tier 1 Grant Program for the Tier 1 water Quality BMP Installation
Project.
BE IT FURTHER RESOLVED that the City of Costa Mesa, agrees to fund its
share of the project costs and any additional costs over the identified
programmed amount.
