Approve the attached resolution (Attachment 1) for the submittal of a grant application to the California Department of Parks and Recreation Statewide Park Development Grant Program for the Costa Mesa Athletic Fields Development Project. 2. Authorize the Department of Public Services Director as the City's authorized representative. BACKGROUND: On November 7, 2006, California voters passed Proposition 84, the $5.4 billion "Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006" (Proposition 84). Funding from Proposition 84 provides grants to cities and counties for the creation of new parks and new recreation opportunities. Competitive grant applications for the Statewide Park Development Grant Program are due on July 1, 2011. Grant awards will be made in the winter of 2012. ANALYSIS: The Public Services Department proposes to submit a grant application to the Statewide Park Development Grant Program in the amount of $1,750,000 for the development of a 6.4 acre parcel of land owned by Southern California Edison (SCE). The property is adjacent to the Santa Ana River between the 1-405 Freeway and MacArthur Boulevard. The property is licensed to Orange County Public Works and remains essentially unimproved except for SCE transmission towers. The proposed project will develop the land into grass athletic fields with fencing, irrigation, decomposed granite trails, landscape and parking improvements. The Orange County Public Works Department and SCE have agreed to the conceptual design of this project. If the grant application is successful, the City will enter into a 30 year agreement with Orange County Public Works for the improvements and use of the fields. To apply for these grant funds a resolution approving the filing of an application and naming the Public Services Director as the City's authorized representative is needed. ALTERNATIVES CONSIDERED: If the Council chooses not to submit a grant application for this project, staff will continue to pursue other grant programs and alternative funding. FISCAL REVIEW: No City funding match is required for this grant program. LEGAL REVIEW: The proposed resolution is approved as to form. CONCLUSION: It is recommended that the Council approve the filing of a grant application with the California Department of Parks and Recreation Statewide Park Development Grant Program for the Costa Mesa Athletic Fields Development Project and designate the Public Services Director as the City's authorized representative. ERNESTO MUIVOZ City Engineer Attachment: 1 - Proposed Resolution c: Chief Executive Officer City Attorney City Clerk Development Services Director Parks Project Manager Contract Administrator PETER NAGHAVI, Director Department of Public Services E Resolution No: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA Approving the Application for STATEWIDE PARK PROGRAM GRANT FUNDS WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility by the Legislature of the State of California for the administration of the Statewide Park Program, setting up necessary procedures governing the Application; and WHEREAS, said procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of application(s) before submission of said application(s) to the State; and WHEREAS, the applicant will enter into a contract with the State of California to complete the grant scope project; NOW, THEREFORE, BE IT RESOLVED that the Costa Mesa City Council hereby: Approves the filing of an application for the Costa Mesa Athletic Fields Development Project, and 1. Certifies that said applicant has or will have available, prior to commencement of any work on the project included in this application, the sufficient funds to complete the project; and 2. Certifies that the applicant has or will have sufficient funds to operate and maintain the project(s), and 3. Certifies that the applicant has reviewed, understands, and agrees to the General Provisions contained in the contract shown in the Grant Administration Guide; and 4. Delegates the authority to the Public Services Department Director to conduct all negotiations, sign and submit all documents, including, but not limited to applications, agreements, amendments, and payment requests, which may be necessary for the completion of the grant scope; and 5. Agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines. PASSED AND ADOPTED the 7th day of June 2011.
