RECOMMENDATION:
1. Accept the work performed by F. Rodgers Corporation and authorize the City Clerk to file the
Notice of Completion.
2. Release the Labor and Material Bond seven (7) months after the filing date; release the Faithful
Performance Bond one (1) year after the filing date; and release the retention monies 35 days
after the Notice of Completion filing date.
BACKGROUND:
On September 21, 2010 a construction contract in the amount of $427,480.00 was awarded to F.
Rodgers Corporation, 2817 East Cedar Street, #100, Ontario, California, 91761. This project was
constructed under the funding guidelines of the American Recovery and Reinvestment Act (ARRA) of
2009.
The scope of work for this project included the installation of metal base flashings, and complete roof
replacement with a cool roof for the Costa Mesa City Hall Building in compliance with Title 24 Energy
Efficiency Standards.

ANALYSIS:
The work required by the contract documents was completed on January 1, 2011, to the satisfaction of
the City Engineer. The final contract cost amounted to $342,237.00. A report of the final costs is shown
herein as Attachment "1 ".
A summary of the costs is as follows:
Original Contract Cost: $ 427,480.00
Change Order No. 1 and No. 2 ($ 85,243.00)
Final Contract Cost: $ 342,237.00
Change Order No. 1 was a credit in the amount of $89,243.00. After the contract was awarded, staff
negotiated a reduction in price to the contract by modifying working hours to eliminate overtime and to
substitute roofing materials with an equal product.
Change Order No. 2 in the amount of $4,000.00 was issued to provide additional gravel on the roof decks
of the City Hall building.
The final contract price reflects a nineteen (20%) percent decrease to the original contract as a result of
the aforementioned change orders.
There has been only one stop notice filed against the monies due to F. Rodgers Corporation to date. This
matter has been resolved by the contractor, and a release of the stop notice has been obtained.
ALTERNATIVES CONSIDERED:
There were no alternatives considered for this item.
FISCAL REVIEW:
This project was funded entirely with ARRA Energy Efficiency and Conservation Block Grant funds.
LEGAL REVIEW:
There is no legal review required on this item.
CONCLUSION:
The American Recovery and Reinvestment Act, Title 24 Cool Roof Replacement at the City Hall, City
Project No. 10-11 has been completed. It is recommended that the City Council authorize staff to file
the Notice of Completion; release the remaining retention monies 35 days after the Notice of
Completion filing date; and release the bonds accordingly.
