Approve the attached resolution (Attachment 1) for the submittal of a grant application to the Urban Greening Grant Program Under the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84), for the Brentwood Park Development Project. 2. Authorize the Department of Public Services Director as the City's authorized representative. BACKGROUND: Competitive grant applications for the Urban Greening Grant Program are due on July 1, 2011. The Urban Greening Grant Program provides funds to preserve, enhance, increase or establish community green space in California. The grant program is administered by the State of California's Strategic Growth Council. Brentwood Park is a neighborhood park which services residents and businesses within '/2 mile radius of the site. In March of 2007, the City of Costa Mesa acquired a 1.2 acre parcel adjacent to the existing 1.45 acre Brentwood Park. The acquired 1.2 acre parcel had previously been operated as a private elementary school. The site included a small parking lot, an office building, classrooms and a swimming pool. The City demolished the existing buildings and incorporated the land into the existing Brentwood Park. A master plan for the now 2.65 acre Brentwood Park was developed by staff, a design consultant, and the community. Phase I of the plan was completed in September 2010 with the installation of an irrigation system, turf and forty-five trees. ANALYSIS: The grant application to the California Strategic Growth Council will request funding of $975,000 for the completion of the Brentwood Park Master Plan. The project includes the development of a decomposed granite path, native landscaping and irrigation, decorative paving, lighting, play areas, exercise stations, a shade structure and picnic area. If grant funding is approved construction may begin in early 2012. To apply for these grant funds a resolution approving the filing of an application and naming the Public Services Director as the City's authorized representative is needed. ALTERNATIVES CONSIDERED: If the Council chooses not to submit a grant application for this project, staff will continue to pursue other grant programs and alternative funding. FISCAL REVIEW: No City funding match is required for this grant program. LEGAL REVIEW: The proposed resolution is approved as to form. CONCLUSION: It is recommended that the Council approve the filing of a grant application with the Urban Greening Grant Program Under the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84), for the Brentwood Park Development Project and designate the Public Services Director as the City's authorized representative. ERNESTO MUNOZ City Engineer Attachment: 1 - Proposed Resolution c: Chief Executive Officer City Attorney City Clerk Development Services Director Parks Project Manager Contract Administrator PETER NAGHAVI, Director Department of Public Services E ATTACHMENT 1 Resolution No: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF.COSTA MESA APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE URBAN GREENING GRANT PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) FOR THE BRENTWOOD PARK DEVELOPMENT PROJECT WHEREAS, the Legislature and Governor of the State of California have provided funds for the program shown above; and WHEREAS, the Strategic Growth Council has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and 1 , WHEREAS, said procedures established by the Strategic Growth Council require a resolution certifying the approval of application(s) by the Applicants governing board before submission of said application(s) to the State; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the Project NOW, THEREFORE, BE IT RESOLVED that Costa Mesa City Council hereby: 1. Approves the filing of an application for the Brentwood Park Development Project, and 2. Certifies that applicant understands the assurances and certification in the application, and 3. Certifies that applicant or title holder will have sufficient funds to operate and maintain the project consistent with the land tenure requirements; or will secure the resources to do so, and 4. Certifies that it will comply with the provisions of Section 1771.8 of the State Labor Code regarding payment of prevailing wages on Projects awarded Proposition 84 Funds, and 5. If applicable, certifies that the project will comply with any laws and regulations including, but not limited to, legal requirements for building codes, health and safety codes, disabled access laws, environmental laws and, that prior to commencement of construction, all applicable permits will have been obtained, and 6. Certifies that applicant will work towards the Governor's State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1, and 7. Appoints the Public Services Department Director, or designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project(s).
