RECOMMENDATION:
1. Adopt plans, specifications, and working details for the construction of the Fairview Park
Wetlands and Riparian Habitat Project, City Project No. 11-06.
2. Accept the withdrawal of the bid submitted by Marina Landscape, Inc., 1900 South Lewis
Street, Anaheim, California, 92805.
3. Award a construction contract to Jeff Tracy, Inc. DBA Land Forms Landscape Construction,
27601 Forbes Road, Suite 36, Laguna Niguel, California, 92677 in the amount of $2,902,978.00
(Base Bid plus Additive Bid Item No. A-1 and A-6).
4. Authorize the Mayor and the City Clerk to execute the Public Works Agreement.
BACKGROUND:
In September 2009, the City completed Phase I of the Fairview Park Wetlands and Riparian Habitat
Project. The project involved the planting of seventeen acres of riparian habitat, grading of wetland
ponds and streams, and the installation of an irrigation system within the northern lower mesa of the
park.
Staff recently secured funding for Phase II of the Fairview Park Wetlands and Riparian Habitat
Project through grants from the Orange County Transportation Authority (OCTA) M2 Environmental
Mitigation Fund, the Transportation Enhancement Fund (TE Grant), the State of California's
Recreational Trail Grant Program, and the MiOcean Foundation.
ANALYSIS:
Phase II park improvements include the installation of a water delivery system to the constructed
wetland ponds, a multipurpose trail, fencing, signage, twenty three acres of native habitat plantings,
and an irrigation system.
On June 6, 2011, the City Clerk received and opened twelve (12) bids for the construction of this
project. The apparent low bidder, Marina Landscape, Inc. submitted a bid in the amount of
$2,212,840. However, Marina Landscape, Inc. has requested to withdraw their bid from
consideration on this project due to a clerical error made in the bidding documents. California
Public Contract Code Section 5101(b) provides for criteria under which a contractor may request to
have their bid withdrawn. A written error by the contractor on the bidding documents falls within this
criteria.
The second apparent low bidder, Jeff Tracy, Inc. DBA Land Forms Landscape Construction (Land
Forms), submitted a bid in the amount of $2,737,986.00, which was 4.9% lower than the Engineer's
estimate of $2,879,990. The average of the eleven (11) properly submitted bids amounted to
$3,074,079.76. The bid abstract is included as Attachment 1 ".
In addition to the base bid, the bidders were required to bid on ten additive bid items which were to
be considered by the City subject to funding availability. These additive items provide optional
features for possible inclusion which were not within the scope of work for the base bid. Based on
the availability of funding and inclusion of the most beneficial features, staff recommends awarding
Additive Bid Items No. A-1 and A-6 with the base bid. Bid Item No. A-1 is for the construction of
three "foot bridges" that will cross over small park streams and allow pedestrian accessibility to the
proposed trails. Bid Item No. A-6 is for the construction of an additional 4,000 linear feet of
decomposed granite trail through the wetlands. The incorporation of the additive bid items will
result in a net increase to the contract of $164,992. Considering the low bid received for this work,
and the overall project cost being below the Engineer's estimate, staff recommends the inclusion of
these two additive items of work.
The license and references of Land Forms has been checked and staff has found them to be in
good standing. Land Forms successfully completed the Landscape Improvements Project in Area
D of Fairview Park in 2009, which included construction of pedestrian trails, the bluff stairs, the
vernal pool overlook, benches, and other amenities.
ALTERNATIVES CONSIDERED:
The alternative to this Council action would be to reject all the bids. If all the bids were rejected, the
City would need to readvertise or cancel the project. Staff believes that readvertising the project will
not result in lower bids and canceling the project is not recommended since delays would
jeopardize the grant funding which is subject to meeting specific deadlines. The Council may also
consider awarding only the base bid. However, considering the favorable bids received for this
work, staff does not recommend this option.
FISCAL REVIEW:
Funding for this project is available from Orange County Transportation Authority (OCTA) M2
Environmental Mitigation Fund, $2,000,000; the Transportation Enhancement Fund (TE Grant),
$500,000; State of California's Recreational Trail Grant Program, $256,000; the MiOcean
Foundation, $350,000; and the City's Park Development Fund $323,000.
LEGAL REVIEW:
Land Forms will furnish the necessary bonds and insurance prior to the commencement of work,
scheduled for July 2011, subject to approval by the City Attorney. After award and subsequent
execution of the contract, a Notice to Proceed will be issued.

CONCLUSION:
The City has received bids for the Fairview Park Wetlands and Riparian Habitat Project, City Project
No. 11-06. Staff has evaluated all of the bids and recommends that the City Council adopt the
plans, specifications, and working details for said project; accept the withdrawal of the bid submitted
by Marina Landscape, Inc.; award the contract to the second apparent low bidder, Jeff Tracy, Inc.
DBA Land Forms Landscape Construction in the amount of $2,902,978.00; and authorize the
Mayor and the City Clerk to execute the Public Works Agreement.
