RECOMMENDED ACTION:
Adopt Resolution that authorizes the Chief Executive Officer (CEO) or his designee to
accept the Grant award from the U.S. Department of Homeland Security (DHS).
BACKGROUND/ ANALYSIS:
The U.S. Department of Homeland Security, through the California Emergency
Management Agency (CalEMA), is distributing funding to local governments under the
FY 2010 Buffer Zone Protection Program (BZPP). The funding is to be used to increase
the preparedness capabilities of jurisdictions responsible for the safety and security of
communities surrounding high-priority pre -designated Tier 1 and Tier 2 critical
infrastructure and key resource (CI/KR) assets, including chemical facilities, financial
institutions, nuclear and electric power plants, dams, stadiums, and other high-risk/high-
consequence facilities, through allowable planning and equipment acquisition. The
identity and location of CI/KR sites are considered sensitive information and are only
provided to appropriate state and local officials for official use only. Specific BZPP sites
within 50 States and one territory have been selected by the U.S. Department of
Homeland Security based on their level of risk and criticality. These sites were selected
by U.S. Department of Homeland Security based on approval of a local agency's
Vulnerability Reduction Plans, which were developed through collaboration of the sites,
CalEMA, and the FBI. Applications are submittedafter sites have been notified of their
selection and award amount.
In February 2010 the Costa Mesa Police Department was notified of the selection of the
federally -identified site within the City of Costa Mesa and the related award of $198,000.
DHS personnel, the identified entity staff and Costa Mesa Police Department Staff
worked together on the BZPP grant application. The Costa Mesa Police Department
submitted the application and was approved to receive the grant in February 2011. The
City of Costa Mesa is awarded the grant but it is staff's recommendation to have the
grant be administered by the County of Orange. The County of Orange will then
assume all audit requirements and liability concerns related to the grant. The recipients
of grant funds will be required to execute the Agreement to Transfer Funds for 2010
Buffer Zone Protection Program Purposes prior to receiving grant funds.
Because the grant is a straight pass-through administered by the County of Orange to
the recipient entity, the funding will be placed in a trust fund set up by the County of
Orange until it is distributed to the recipient entity, and will not be added to the budget.
ALTERNATIVES CONSIDERED:
None.
FISCAL REVIEW:
There are no City funds required to obtain the grant. The only City funds recognized at
this time is from staff time to review this report.
LEGAL REVIEW:
The City Attorney's Office has reviewed the Grant Agreement and associated
documents and has approved it as to form and content.
CONCLUSION:
Based upon an analysis of the Grant Agreementgd the available benefits to the City
offered by the award of the grant, Department staff sbpports the approval of the above
list d reco mendation.

I am pleased to inform you that the FY 2010 Buffer Zone Plans (BZPs) and Vulnerability
Reduction Purchase Plans (VRPPs) for the following jurisdictions have been approved by the
California Emergency Management Agency (Cal EMA) and the Federal Department of
Homeland Security (DHS).
As the subgrantee, you and/or the responsible jurisdictions may now proceed with procuring the
requested equipment identified in the approved VRPPs. However, prior to grant reimbursement,
the subgrantee must provide Cal EMA with a Governing Body Resolution, Grant .Assurances,
and Financial Management Forms Workbook. I ask that you provide these documents as soon as
possible to. avoid any delays in reimbursements. For document templates or questions regarding

The identity and location of CIKR sites are considered sensitive information and
(FOLIO)
may only be_provided to appropriate State and local officials for official use only.
Site information associated with BZPP, including Buffer Zone Plan and VRPP, must
be properly safeguarded and handled in accordance with its designated markings.
Protected Critical
The PCII Program, part of the U.S. Department of Homeland Security's (DHS)
Infrastructure
National Protection and Programs Directorate (NPPD), is an information protection
Information (PCII)
program to enhance information sharing between the private sector and the
government. Qualifying information voluntarily submitted to the government and
validated as PCII is protected from public disclosure under the Freedom of
Information Act (FOIA) and similar State and local disclosure laws, and use in civil
litigation.
DHS and other Federal, State and local analysts use PCII in pursuit of a more
secure homeland, focusing primarily on:
• :Analyzing and securing critical infrastructure and protected systems;
• Identifying vulnerabilities and developing risk assessments; and
• Enhancing recovery preparedness measures

Performance Period
Subgrantee performance period ends February 31, 2013.
Governing Body
Subgrantees must submit a Governing Body Resolution to Cal EMA prior to

drawdown of funds. Mail Resolution to: California Emergency Management

Grant Assurances
Subgrantees must submit a signed Grant Assurances Form to Cal EMA prior to
drawdown of funds. For copies of the form contact Peter Town, Cal EMA Grants
Management Division, at (916) 322-1503 or peter.townO-calema.ca.gov.
Liquidation Period
Final request for reimbursement for the 2010 BZPP must be received by Cal EMA
no later than 30 days from the expiration date of the subgrantee performance
period. At the completion of this 30 -day subgrantee liquidation period, Cal EMA
may disencumber and redirect any remaining funds.
Reimbursement
Subgrantees should download the Financial Management Forms Workbook located

on Cal EMA's website under OHS Divisions, Grants Management tab at
www.calema.ca.gov. Grant reimbursement questions should be directed to Peter
Town at (916) 322-1503 or peter.town(mcalema.ca.gov.
Grant Reporting
Subgrantees must prepare and submit performance reports to Cal EMA for the
duration of the grant performance period, or until all grant activities are completed
and the grant is formally closed. Subgrantees must complete a Biannual Strategy
Implementation Report via online Grants Reporting Tool (GRT) at
https://www.reporting_odp.dhs.gov, and will also be required to submit additional
information and data requested by Cal EMA. Questions regarding BZPP reporting

Modification Request
Modification requests to BZP or VRPP are considered on a case by case basis and
should be directed to Jose Lara, Critical Infrastructure Protection Division, at (916)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, AUTHORIZING
APPLICATION FOR, AND ACCEPTANCE OF, A GRANT
AWARD FROM THE U.S. DEPARTMENT OF
HOMELAND SECURITY (DHS).
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS`:
WHEREAS, the U.S. Department of Homeland Security (DHS), has made funds
available through the California Emergency Management Agency (CaIEMA) for a Buffer
Zone Protection Plan grant , as set forth in the Grant Agreement; and
WHEREAS, the City of Costa Mesa supports the grant goals and wishes to
participate in the Buffer Zone Protection Plan; and
WHEREAS, the City of Costa Mesa has been awarded $198,000 from the
California Emergency Management Agency (CaIEMA); and
NOW, THEREFORE, BE IT RESOLVED that, the City Council of Costa Mesa
hereby approves the application for and acceptance of a grant from the California
Emergency Management Agency (CaIEMA) and the Chief Executive Officer or his
designee is hereby authorized to implement this authorization.
