Election Day
In case any measure is to be submitted at a special election where no candidates are to
be elected, the Election Official shall publish a synopsis of the measure once. There is
no deadline in the Elections Code, publish once before election day. If there is no
newspaper of general circulation published and circulated in the city, the notice shall be
typewritten and copies shall be posted conspicuously within the time prescribed in at
least three public places in the city
(Form N-1).

The Election Official shall set the date for the deadline for the filing of arguments and
impartial analyses. Arguments may be changed or withdrawn by their proponents until
and including the date fixed by the Election Official.
(See §§ 9280 — 9287, 9295, Elections Code.)
The Election Official shall make a copy of the materials referred to in §§ 9223 (copy of
ordinance), 9280 (city attorney analyses), 9281 and 9282 (arguments), and 9285
(rebuttals), available for public examination in the Election Official's office for a period of
10 calendar days immediately following the filing deadline for submission of those
materials. Any person may obtain a copy of such materials from the Election Official for
use outside of the Election Official's office. The Election Official may charge a fee to any
person obtaining a copy of the material, which fee shall not exceed the actual cost
incurred by the Election Official in providing the copy.

During the 10-day examination period provided by this section, any voter of the
jurisdiction in which the election is being held, or the Election Official, himself or herself,
may seek a writ of mandate or an injunction requiring any or all such materials to be
amended or deleted. A peremptory writ of mandate or an injunction shall be issued only
upon clear and convincing proof that the material in question is false, misleading or
inconsistent with the requirements of this chapter, and that issuance of the writ or
injunction will not substantially interfere with the printing or distribution of official election
materials as provided by law.

A measure placed on the ballot may be amended or withdrawn by resolution filed with
the election official by the 83rd day before the election.

Last day for elections official to designate polling places and appoint precinct board
members.

Following the designation of polling places and the appointment of precinct board
members, the elections official shall immediately mail or deliver to each precinct board

Between these days (both days included), any voter entitled to vote by vote -by -mail vote
ballot may file a written or electronic application for a vote -by -mail voter ballot with the
Election Official. The written application shall be signed by the applicant and shall show
his place of residence. The electronic application does not need a signature.
Applications received prior to the first day of the period shall be held and processed by
the Election Official following the first day of the period, in the same manner as if
received at that time.

Any individual, organization, or group that distributes applications for vote -by -mail voter
ballots and receives completed application forms shall return the forms to the
appropriate elections official within 72 hours of receiving the completed forms, or
before the deadline for application, whichever is sooner. The name, address, and
telephone number of any organization which authorizes the distribution of the
applications shall be included on the application.
Upon receipt of any Vote -by -Mail ballot application, which arrives within the proper time,
the elections official should determine if the residence address (and signature) on the
ballot application appear to be the same as that on the original affidavit of registration.
The official may make this signature check upon receiving the voted ballot, but the
signature must be compared before the Vote -by -Mail voter ballot is canvassed.
May 15 E -21 Last Day to Mail Sample Ballots and Polling Place Notices
Last day for the Election Official to mail to each registered voter (registered by 54 days
before the election) a sample ballot and a polling place notice showing the location of t
precinct polling place of the voter.

Affidavits of registration shall be accepted at all times except during the 14 days
immediately preceding any election, when registration shall cease for that election as to
electors residing in the territory within which the election is to be held. Transfers of
registration for an election may be made from one precinct to another precinct in the
same county at any time when registration is in progress in the precinct to which the
elector seeks to transfer.

Where the elections official finds the need for voting assistance for qualified citizens in
certain voting precincts, the elections official shall make reasonable efforts to recruit
precinct board members who are fluent in a language used by citizens in those
precincts. At least 14 days before the election, the elections official shall prepare and

Any jurisdiction having the necessary computer capability may start to process vote -by -
mail ballots on the seventh business day prior to the election. Processing vote -by -mail
ballots includes:
- opening vote -by -mail ballot return envelopes
- removing ballots from envelopes and secrecy sleeves if used
- duplicating any damaged ballots
- preparing the ballots to be machine read/orienting corner cuts
but under no circumstances may a vote count be accessed or released until 8 p.m. [or
close of polls] on the day of the election. All other jurisdictions (using Hand Tally ballots)
shall start to process vote -by -mail ballots at 5 p.m. on the day before the election.
(§ 15101(b), Elections Code.)
The Elections Official shall keep an accurate list of all voters who have received and
voted a vote -by -mail voter ballot at each election and compare this list with the Roster
Voters as provided in § 15278 to check whether the voter has voted more than once in
any election.

May 26 E -10 Publish Notice of Central Counting Place
Whenever the ballots at any election or from any precincts are to be tallied at a central
place and not at the precincts, the elections official or secretary of the jurisdiction
conducting the election shall specify the public place to be used and give notice thereof
as follows:
(a) By at least one publication in a newspaper of general circulation published in the
jurisdiction where the election is to be held, provided that the publication is made at
10 days before the day of the election.
(b) If a newspaper of general circulation is not published in that jurisdiction, then by
prominently posting the notice in the office of the elections official for at least 10 days
before the day of the election.

May 29 E -7 Last Day to Publish Notice of Polling Places
Last day for Election Official to publish the polling places designated for each election
precinct once in a newspaper in the city. If there is no newspaper of general circulation

Between these days (both days included) any voter unable to go to the polls because of
conditions resulting in his or her absence from the precinct on election day may request
in a written statement, signed under penalty of perjury that a ballot be delivered to him or
her. This written statement shall not be required if the Vote -by -Mail voter ballot is voted
in the office of the elections official as defined by subdivision (b) of Section 3018, at the
time of the request. This ballot shall be delivered by the elections official to any
authorized representative of the voter who presents this written statement to the official.

Before the election the elections official shall send to the inspector of each precinct in h
city a list of the voters in that precinct applying for and receiving ballots under the
provisions of this chapter.

June 1 E -4 Suggested Last Day to Post Notice of Manual Tally
The election official shall notify observers and the public at least 5 days in advance of
the dates, times, and places where ballots of 1 precinct and the corresponding vote -by -
mail ballots will be manually counted. Cities with ballot groups must manually count as
many precincts as it takes to manually count each office that appears on the ballots, but
only the additional offices need be counted in the additional precincts.

It is suggested the Election Official post the notice no later than the Friday before the
election.

June 4 E -1 Post Notice — Post -Election Vote -by -Mail Canvass
The election official shall notify Vote -by -Mail voter observers and the public at least 48
hours in advance of the dates, times, and places where late Vote -by -Mail ballots and
Provisional ballots will be processed and counted.

The polls shall be open on the day of election between such hours as the City Council
may determine, but not less than eight consecutive hours. The hours of opening and
closing the polls shall be specified in the notice of election, otherwise, they shall be the
same as provided for general elections.

The Election Official, or a canvassing board appointed by the Election Official, shall
count the votes cast by Vote -by -Mail voters. The canvassing board, if any, shall be
appointed and the Vote -by -Mail vote count shall be conducted in the manner prescribed
by §§ 15101 to 15112, Elections Code. The result of the count shall be included with the
canvass of returns from the precincts.

§ 15301 shall govern the conduct of the canvass. This shall include:
1. Processing the Provisional Ballots.
2. Processing the Vote -By -Mail ballots received at the polls on election day.
3. Review each Roster for completion of all forms.
4. Review and completion of the Ballot Statement on the front of the Rosters.
5. Compare the list of Vote -by -Mail voters with the Roster of Voters as provided in
§ 15278 to check whether any voter has voted more than once in any election.

No Later Than E+ 24 Election Official to Conduct the Manual Tally
June 29
During the official canvass, the election official shall conduct a public manual tally of the
ballots tablulated, including Vote -by -Mail voter ballots, cast in 1 % of the precincts, or 1
whole precinct, chosen at random. For each race not included on the initial precinct, the
election official shall count additional precincts, until all races have been manually tallied
The manual tally in the addtional precincts shall only apply to the race(s) not previously
tallied.
The ballots for the Vote by Mail ballot tally need not be from the same precinct as
the polling place ballots come from.
A report on the results of the Manual Tally shall be included in the Certification of the
Official Canvass of the vote. The report shall identify any discrepancies between the
machine and the manual tally and a description of how each of these discrepancies was

closing date shall be June 30.

On or before April 1 of each odd -numbered year, the Election Official of each legislative
body shall file a report with the Secretary of State containing the following information:
(a) The number of municipal initiative petitions circulated during the preceding two
calendar years which did not qualify for the ballot, and the number of these proposed
initiatives for which reports were prepared pursuant to Section 9212.
(b) With respect to municipal initiative measures that qualified for the ballot in the
preceding two calendar years, the number which were approved by the voters, and the
number of these ballot measures for which reports were prepared pursuant to Section
9212.
(c) With respect to municipal initiative measures that qualified for the ballot in the
preceding two calendar years, the number which were not approved by the voters, and
the number of these ballot measures for which reports were prepared pursuant to
Section 9212.
