RECOMMENDATION:
1. Adopt plans, specifications, and working details for the Baker Street and Bear Street
Intersection Improvements, City Project No. 11-10.
2. Approve Budget Adjustment No. 12-017 (Attachment 1) in the amount of $242,500.
3. Award a construction contract to C.T. & F., Inc., 7228 Scout Avenue, Bell Gardens, CA 90201,
in the amount of $194,356.65.
4. Approve Supplemental Agreement in the amount of $40,000, and authorize the CEO to
execute the subsequent change order to follow.
5. Authorize the Mayor and the City Clerk to execute the Public Works Agreement.
BACKGROUND:
Bear Street provides direct access to SR -73 Freeway and Baker Street provides access to SR_*
55 Freeway. Bear Street also provides access to major shopping centers, including South
Coast Plaza and Metro Pointe. Both streets are classified as Major Arterials, according to the
Orange County Transportation Authority's (OCTA) Master Plan of Arterial Highways (MPAH).
There is significant traffic on Baker Street especially in the westbound direction in the evening
peak hour. As a consequence, there is a significant amount of congestion and delays for the
westbound direction at the Baker Street — Bear Street intersection during the evening peak hour
period. The City's General. Plan Circulation Element includes the improvement to add a
westbound through lane at this intersection.
In 2011, the City was successful in securing an OCTA Measure M2 grant under the Intersection
Capacity Enhancement (ICE) program to construct General Plan Circulation Element
improvements at the intersection of Baker Street and Bear Street.
ANALYSIS:
Based on staff's review of critical traffic movements within this area, the improvements required
to mitigate the sub -standard traffic conditions include revising Baker Street to include three
westbound through lanes, in compliance with Master Plan standards. In addition, the project will
implement traffic signal modifications at the subject intersection. The project consists of new
curb and gutter, paving, roadway striping, furnishing and installing a new traffic signal controller,
signal equipment, conduit, conductors and cable, cabinet integration, fiber optic cable, closed
circuit television (CCTV) assembly, network equipment, Americans with Disabilities Act (ADA)
accessible curb ramps, and all incidental work.
The City Clerk received and opened seven (7) bids for this project on February 27, 2012. C.T.
& F, Inc. was the apparent low bidder with a base bid proposal of $194;356.65. The Engineer's
estimate for this work was $240,125; and the average of the seven (7) base bids received
amounted to $207,484.0-9. An analysis of the bids indicates that the appaierit low bidder
submitted a proposal that is nineteen percent (19%) lower than the Engineer's estimate. The
variance between the low bidder and the Engineer's estimate may be attributed to continued
competitive conditions in the construction industry at this time. The Bid Abstract is included as
Attachment "2".
The apparent low bid is substantially lower than the Engineer's estimate and the funding allocated
for the project. The City has identified certain supplemental work items that could be included to
maximize the utilization of available resources to the project. The supplement work for this project
will consist of upgrading the traffic signal poles to handle larger mast arms and to provide for
additional traffic signal indications. In addition, the traffic lane markings will be extended and
revised correctly to further improve traffic flow and turning abilities. After the approval of this
contract and the Supplemental Agreement, staff will negotiate a change order to perform the
supplemental work. The extent of the work will not exceed the $40,000 in available grant funding.
It is recommended that the CEO be authorized to execute this change order.
The license and references of C.T. & F., Inc. were checked and staff has found them to be in
good standing.
ALTERNATIVES CONSIDERED:
The alternative to this Council action would be to reject all the bids. If all the bids were rejected,
the City would then need to readvertise or'to cancel the project. Staff believes that readvertising
the project will not result in lower bids.
If the supplemental agreement is -not approved by this Council Action, the balance of the grant
monies will be returned to the grant source in lieu of being utilized for the enhancement of the
signalized intersection.
FISCAL REVIEW:
Funding for this project is available from the approved OCTA Measure M2 grant in the amount of
$181,500, and matched by Traffic Impact Fee funds in the amount of $61,000. The attached
Budget Adjustment No. 12-017 allocates the grant funding and the Traffic Impact Fee funds from
the available fund balance towards the construction of the project.
LEGAL REVIEW:
C.T. & F., Inc. has furnished the necessary bonds and insurance, which have been approved as
to form by the City Attorney's office. After the award and subsequent execution of the contract a
"Notice to Proceed" will be issued. '
CONCLUSION:
The City has received bids for the Baker Street and Bear Street Intersection Improvements, City
Project No. 11-10. Staff has evaluated all of the bids and. recommends that the City Council adopt
the plans, specifications, and working details for said project; approve Budget Adjustment No. 12-
017 in the amount of $242,500; award the contract to the apparent low bidder C.T. & F., Inc. in the

amount of $194,356.65, approve Supplemental Agreement and authorize the CEO to execute the
subsequent change orders; and authorize the Mayor and the City Clerk to execute the Public
Works Agreement.
