RECOMMENDATION:
Adopt a Resolution approving the submittal of transportation improvement projects under
the Orange County Transportation Authority's (OCTA) Bicycle Corridor Improvement
(BCI) Program for Fiscal Years 2012-13 to 2013-14 (Attachment 1).
BACKGROUND:
The BCI Program is funded using federal Congestion Mitigation and Air Quality (CMAQ)
funds, first authorized under the Intermodal Surface Transportation Efficiency Act
(ISTEA) of 1991, and subsequently reauthorized under the Transportation Equity Act
for the 21st Century (TEA -21) in 1998, and the Safe, Accountable, Flexible, Efficient
Transportation Equity Act: a Legacy for Users (SAFETEA-LU) in 2005, and extended
thereafter through several continuing resolutions. The CMAQ program provides funding
through annual appropriations to OCTA to be used for transportation -related projects
that reduce congestion and improve air quality. OCTA is responsible for selecting
regionally significant projects for Orange County and working with the State of
California Department of Transportation (Caltrans) in administering selected projects.
ANALYSIS:
On February 13, 2012, the OCTA Board of Directors approved the "BCI 2012 Call for
Projects." This competitive program will make $9 million in federal CMAQ funds
available for bicycle projects. Projects eligible for CMAQ funding through this "Call for
Projects" include bicycle facilities and bicycle safety/outreach projects. Each project is
limited to $1 million in CMAQ funds covering Fiscal Years 2012-13 to 2013-14. A
minimum local match of twelve (12) percent is required.
Eligible projects may include:
Bicycle facilities, e.g., gap closures, bike lockers, bikeways, and bike racks.
Bicycle multi -use recreation trails and facilities.
Bicycle safety/outreach programs.
Staff has analyzed the need for bicycle facility improvements and bicycle safety
outreach within the City, and on April 30, 2012 submitted grant applications for three
projects. OCTA requires approval of the attached resolution by June 30, 2012, prior to
consideration of the City's applications. Proposed projects for which funding
applications are requested to be submitted are listed in the attached resolution
(Attachment 1) and are briefly described in Attachment 2.
ALTERNATIVES CONSIDERED:
Council may consider to not adopt the Resolution. However, this alternative is not
recommended as it would result in the City's project applications being declined and
render the City ineligible to compete for available grant funding.
FISCAL REVIEW:
If staff is successful in capturing grant funding for these projects, we will bring back a
report to recommend a funding source for any required local match. Available sources
include Air Quality Management District (AQMD) AB2766 funds, Fairview Park
Development funds, and the General Fund. All of these funding sources are eligible for
local match funds under the BCI guidelines. If grant funding is captured, the projects are
typically implemented within a two-year period. This would allow for the City to adequately
budget any required matching funds.
LEGAL REVIEW:
The City Attorney has reviewed and approved the Resolution as to form.
CONCLUSION:
The current "2012 Call for Projects" provides an opportunity for the City to compete for
grant funding for implementation of bicycle projects under the 2012 Bicycle Corridor
Improvement Program. Staff recommends that the City Council adopt the attached
Resolution for OCTA's consideration of project applications submitted for BCI Program
funding.

RESOLUTION NO. 12-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA AUTHORIZING APPLICATION FOR
FUNDS FOR THE BICYCLE CORRIDOR IMPROVEMENT
PROGRAM FUNDED WITH CONGESTION MITIGATION
AND AIR QUALITY PROGRAM UNDER THE 2005 SAFE,
ACCOUNTABLE, FLEXIBLE, EFFICIENT;
TRANSPORTATION ACT - LEGACY FOR USERS OR
SUBSEQUENT FEDERAL TRANSPORTATION ACT FOR
BICYCLE PROJECTS IN COSTA MESA.
THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES,
DETERMINES AND ORDERS AS FOLLOWS:
WHEREAS, the United State Congress enacted the Safe, Accountable, Flexible,
Efficient, Transportation Equity Act - Legacy for Users August 2005, which makes
Congestion Mitigation and Air Quality funds available to the Orange County
Transportation Authority (OCTA); and
WHEREAS, OCTA has established the procedures and criteria for reviewing
proposals; and
WHEREAS, the City of Costa Mesa Public Services Director ("Public Services
Director") possesses authority to nominate bicycle projects funded using Congestion
Mitigation and Air Quality funding and to finance, acquire, and construct the proposed
project; and
WHEREAS, the City Council of the City of Costa Mesa ("City Council") authorizes
the nomination of the Fairview Park Bike Trail Project, Bicycle Education and Bicycle
Rack at Schools Project, and the Placentia Avenue Bike Signal Project ("Project" or
"Projects") for the Bicycle Corridor Improvement Program and authorizes the Public
Services Director as the official representative of the City of Costa Mesa to act in
connection with the nomination and to provide such additional information as may be
required; and
WHEREAS, the City of Costa Mesa will maintain and operate the property acquired,
developed, rehabilitated, or restored for the life of any facilities or activities; and
WHEREAS, with the approval of the California Department of Transportation
("Caltrans") and OCTA, the City of Costa Mesa or its successors in interest in the
property may transfer the responsibility to maintain and operate the property; and
WHEREAS, the City of Costa Mesa will give Caltrans and OCTA representatives
access to and the right to examine all records, books, papers or documents related to
the Projects; and
WHEREAS, the City of Costa Mesa will cause work on the Projects to be
commenced within six months of notification by Caltrans that funds have been
authorized to proceed by the Federal Highway Administration and that the project will
be carried to completion with reasonable diligence; and
WHEREAS, the City of Costa Mesa agrees to fund its share of the total project costs
awarded by OCTA for the Bicycle Improvement Program and to pay any additional
costs over the identified program amount; and
WHEREAS, the City of Costa Mesa will comply where applicable with provisions of
the California Environmental Quality Act, the National Environmental Policy Act, the
American with Disabilities Act, Federal Transit Administration Title VI, and any other
federal, state, and/or local laws, rules and/or regulations;

WHEREAS, the City Council authorizes the execution of any necessary cooperative
agreements between the City of Costa Mesa and OCTA to facilitate the delivery of the
Projects.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa
Mesa, hereby authorizes the Public Services Director as the official representative of
the City of Costa Mesa to apply for the Congestion Mitigation and Air Quality funding
under the Safe, Accountable, Flexible, Efficient Transportation Equity Act - Legacy for
Users for the project proposals submitted by the City.
BE IT FURTHER RESOLVED that the City of Costa Mesa agrees to fund its share
of the project costs and any additional costs over the identified programmed amount.

PROPOSED PROJECTS FOR BCI
1. Fairview Park Multipurpose Trail
The proposed project includes construction of a new Class I Multipurpose Trail within
Fairview Park. The proposed trail will consist of a new 8 -foot wide concrete path for a
length of approximately 5,300 feet. The trail will follow a path through the central area of
Fairview Park and connect three distinct areas. The proposed trail will start at the terminus
of Canyon Drive and extend northerly to Talbert Nature Preserve, and also diverge
easterly and connect to Placentia Avenue. Currently there are only make -shift foot -paths
in this area of Fairview Park and no improved paths. Certain areas of the foot -path suffer
from poor drainage which will be addressed by the project.
Total Project Cost (Design and Construction Phases): $1,247,700
Grant Amount Requested: $835,959
City Match: $411,741
2. Bicycle Education at Schools and Bicycle Racks at City Facilities
The proposed project includes two main components of bicycle safety education and
promotion at elementary schools, and installation of new bicycle racks at seven City
facilities. The purpose of this project is to encourage and promote safe bicycling in the
community by providing bicycle safety education for students at an early age and by
providing bicycle racks at carefully selected City facilities near busy activity centers.
Total Project Cost (Design and Construction Phases): $177,650
Grant Amount Requested: $154,556
City Match: $23,094
3. Placentia Avenue Bicycle Signal
The proposed project includes the installation of a new bicycle/pedestrian signal on
Placentia Avenue adjacent to Fairview Park. The proposed signal would be located where
the new bicycle trail being constructed south of Fairview Channel meets Placentia Avenue.
The bicycle signal will provide a safe method of crossing Placentia Avenue to access the
bicycle trail.
