Adopt plans, specifications, and working details for the Improvements of Alley No. 28, Alley No. 29, and Alley No. 30, City Project No. 12-03. 2. Award a construction contract to Black Rock Construction Company, 282 North St. Crispen, Brea, CA 92821, in the amount of $428,000.25 (base bid). 3. Authorize the Mayor and the City Clerk to execute the Public Works Agreement. BACKGROUND: The City owns and maintains 129 alleys. A Citywide Alley Improvement Report was presented to the City Council in September 2007. At that time the Council approved a City Alley Improvement Priority List to address the City's Alley System beginning with those alleys in most need of improvement. To date, 35 alleys have been fully improved, and with this project the following alleys will be rehabilitated: 1) Hickory Drive Alley (Alley No. 28) located south of Baker Street; 2) Pepper Tree Lane Alley (Alley No. 29) located west of Harbor Boulevard; 3) Harbor Blvd Alley (Alley No. 30) located north of Ponderosa Street. ANALYSIS: The pavement rehabilitation process for Alley No. 28, Alley No. 29, and Alley No. 30 consists of removal of the existing asphalt concrete alley sections, the construction of new Portland Cement Concrete (PCC) pavement sections, storm drain improvements, and other incidental work needed to complete the project in accordance with the contract documents. The City Clerk received and opened seven (7) bids for this project on April 11, 2012. Black Rock Construction Company was the apparent low bidder with a base bid proposal of $428,000.25. The Engineer's estimate was $515,303.00; and the average of the seven (7) base bids received amounted to $564,338.41. An analysis of the bids indicates that this apparent low bidder submitted a base bid proposal that is seventeen percent (17%) lower than the Engineer's estimate. The variance between the low bidder and the Engineer's estimate may be attributed to the highly competitive conditions prevalent in the construction industry at this time. The Bid Abstract is included as Attachment "I". The license and references of Black Rock Construction Company were checked and staff has found them to be in good standing. Black Rock Construction Company has successfully completed other City projects including most recently rehabilitation of Alley No. 47 (between Cleveland Avenue and Coolidge Avenue and from Baker Street to Paularino Avenue), Alley No. 116 (east of Newport Boulevard from 23rd Street to Wilson Street), the northerly portion of Alley No. 75 (west of Fullerton Avenue and south of Flower Street), and Alley No. 76 (south of Flower Street from Alley No. 75 to Fullerton Avenue). ALTERNATIVES CONSIDERED: The alternative to this Council action would be to reject all the bids. If all the bids are rejected, the City would need to readvertise or cancel the project. Staff believes that readvertising the project will not result in lower bids. FISCAL REVIEW: Funding for this project has been budgeted with the use of Gas Tax funds. LEGAL REVIEW: Black Rock Construction Company has furnished the necessary bonds and insurance, which were approved as to form by the City Attorney. After the award and subsequent execution of the contract, a "Notice to Proceed" will be issued. CONCLUSION: The advertisement and bid opening for the improvements of Alley No. 28, Alley No. 29, and Alley No. 30, City Project No. 12-03, has been completed. It is recommended that the City Council adopt the plans, specifications, and working details for said project; award the contract to the apparent low bidder, Black Rock Construction Company, in the amount of $428,000.25 (base bid); and authorize%rtor d the City Clerk to execute the Public Works Agreement.
