RECOMMENDATION:
1. Adopt plans, specifications, and working details for the East Side Slurry Seal Project, City
Project No. 12-06.
2. Award a construction contract to Pavement Coatings Co., 10240 San Sevaine Way, Jurupa
Valley, California, 91752, in the amount of $626,807.20 (base bid plus additive bid item).
3. Authorize the Mayor and the City Clerk to execute the Public Works Agreement.
BACKGROUND:
The East Side Maintenance Project consists of the following three individual projects with a total
construction cost of over $6.3 million.
1. Parkway and Concrete Repair Project — Will repair the damaged curb and gutter,
sidewalk, cross -gutters and driveways.
2. Asphalt Concrete Paving Project — Will mill and overlay major streets (such as Orange
Avenue, Tustin Avenue, and Santa Ana Avenue). In addition, the contractor will be
placing a thin overlay on streets with minor surface distress.
3. Slurry Seal Project — Will apply a thin surface coating to extend the life of the wearing
surface and to seal the street.
By phasing the work into areas of specialty, the City was able to realize an overall savings of
$600,000 from last year's contract prices.
The renewed Measure M (M2) funding program requires that cities in Orange County maintain
a uniform approach to rating and evaluating streets, and use of a standardized Pavement
Management Program. Based on the pavement analysis recommendations and field review,
staff prepared a prioritization list and recommendation of streets to be repaired, which were
included in the scope of work for the East Side Street Improvement Project.
The streets proposed for maintenance under the East Side Street Improvement Project are
within the target area bounded by Irvine Avenue and Newport Boulevard, and 15th Street and
21st Street. A listing of the streets is included on Attachment "'I".

ANALYSIS:
The overall scope of the East Side Maintenance Project includes the removal and reconstruction
of damaged pavement sections, milling and overlaying with new asphalt, and reconstruction of
damaged parkway improvements over the entire project limits. Part of the work also includes the
application of a Type I slurry seal pavement coating, and the replacement of traffic markings,
striping, and traffic control markings. The scope of this contract covers the application of slurry
seal coatings and traffic markings only, in coordination with the other two phases of work, namely
the Parkway Concrete Repair and the Pavement Rehabilitation. The contractor is required to
complete all of the tasks necessary to perform the work as outlined in the contract documents.
The City Clerk received and opened seven (7) bids for this project on April 27, 2012. Pavement
Coatings Co. was the apparent low bidder with a base bid proposal of $623,507.20. The
Engineer's estimate was $673,736.00; and the average of the seven (7) base bids received
amounted to $678,201.46. An analysis of the bids indicates that this apparent low bidder
submitted a base bid proposal that is 7.5% lower than the Engineer's estimate. The variance
between the low bidder and the Engineer's estimate may be attributed to the highly competitive
conditions prevalent in. the construction industry at this time. The Bid Abstract is included as
Attachment "2".
In addition to the base bid, the bidders were required to provide a price for one additive bid item to
be considered for award only if the bids were favorable and funding was adequate to cover the
additional cost. Additive Bid Item A consists of additional labor and material to seal oil, gas, and
grease spots on the asphalt surface prior to the slurry seal application to ensure a longer lasting
slurry seal coating. The incorporation of the additive bid items will result in a net increase to the
contract of $3,300.00. Due to the favorable bid received for this work, and the overall project cost
being below the Engineer's estimate, staff recommends the inclusion of the additive item of work.
The license and references of Pavement Coatings Co. were checked and staff has found them to
be in good standing. Pavement Coatings Co. successfully completed the Slurry Seal and Crack
Seal Project in 2002, which included an identical scope of work in another area of the City.
ALTERNATIVES CONSIDERED:
The alternative to this Council action would be to reject all the bids. If all the bids were rejected,
the City would need to readvertise or cancel the project. Staff believes that readvertising the
project will not result in lower bids and canceling the project is not recommended because the
streets are in need of the proposed street maintenance work.
FISCAL REVIEW:
This project will be fully funded from available Measure "M" Turn Back funds.
LEGAL REVIEW:
Pavement Coatings Co. has furnished the necessary bonds and insurance, which have been
approved as to form by the City Attorney's office. After the award and subsequent execution of
the contract, a "Notice to Proceed" will be issued.
CONCLUSION:
The City has received bids for the Slurry Seal phase of the East Side Improvement Project, City
Project No. 12-06. Staff has evaluated all of the bids and recommends that the City Council adopt
the plans, specifications, and working details for said project; award the contract to the apparent
low bidder, Pavement Coatings Co., in the amount of $626,807.20 (base bid plus additive bid
item); and authorize the Mayor and the City Clerk to execute the Public Works Agreement.
