RECOMMENDATION:
1. Adopt plans, specifications, and working details for the Parkway Concrete Repair and New
Sidewalk Construction Project, City Project No. 12-04.
2. Award a construction contract to Black Rock Construction Company, 282 North St. Crispen,
Brea, CA 92821, in the amount of $2,121,684.00 (base bid plus all additive bid items).
3. Authorize the Mayor and the City Clerk to execute the Public Works Agreement.
BACKGROUND:
The East Side Maintenance Project consists of the following three individual projects with a total
construction cost of over $6.3 million.
1. Parkway and Concrete Repair Project — Will repair the damaged curb and gutter,
sidewalk, cross -gutters and driveways.
2. Asphalt Concrete Paving Project — Will mill and overlay major streets (such as Orange
Avenue, Tustin Avenue, and Santa Ana Avenue). In addition, the contractor will be
placing a thin overlay on streets with minor surface distress.
3. Slurry Seal Project — Will apply a thin surface coating to extend the life of the wearing
surface and to seal the street.
By phasing the work into areas of specialty, the City was able to realize an overall savings of
$600,000 from last years contract prices.
Concrete improvements located within the City's parkways and streets require ongoing repair and
maintenance due to age, maturing trees, soil conditions, water intrusion, and traffic loads. The
City's Parkway Concrete Repair Program is funded to repair as many of these damaged areas as
possible, and eliminate the potential liability associated with aging parkways. The locations
identified for repair are prioritized based on pedestrian and handicap traffic and the severity of the
damage.
The City's New and Missing Link Sidewalk Program addresses the installation of concrete
sidewalks on City streets that do not have a continuous sidewalk along the entire block.
Pedestrians typically use the traffic pavement area for their path of travel where these sidewalk

segments are missing. The list of parkway improvement locations and missing sidewalk locations
within the scope of work for this contract is included as Attachment "1 ".
The Parkway Maintenance and the New and Missing Link Sidewalk Programs were combined as
a single project to take advantage of the economy of scale savings associated with a larger
project. The majority of the work is bounded by Irvine Avenue and Newport Boulevard, and 15th
Street and 21St Street.
ANALYSIS:
The scope of work under this contract consists of localized reconstruction of curb and gutter;
cross gutter and spandrels; sidewalks; incidental roadway reconstruction; driveway approaches
and other work needed to complete the project in accordance with the contract documents.
The City Clerk received and opened nine (9) bids for this project on April 6, 2012. Black Rock
Construction Company was the apparent low bidder with a base bid proposal of $1,971,684.00.
The Engineer's estimate was $2,831,560.00; and the average of the nine (9) base bids received
amounted to $2,727,034.00. An analysis of the bids indicates that this apparent low bidder
submitted a base bid proposal that is thirty percent (30%) lower than the Engineer's estimate.
The variance between the low bidder and the Engineer's estimate may be attributed to the highly
competitive conditions prevalent in the construction industry at this time. The Bid Abstract is
included as Attachment "2".
In addition to the base bid, the bidders were required to provide prices on three additive bid items
to be considered for award only if the bids were favorable and funding was adequate to cover the
additional cost. These additive items (AD1, AD2, and AD3) consist of additional labor and material
to increase the number of locations that may be repaired with this contract. The incorporation of
the additive bid items will result in a net increase to the contract of $150,000.00. Due to the
favorable bid received for this work, and the overall project cost being below the Engineer's
estimate, staff recommends the inclusion of the additive items of work.
The license and references of Black Rock Construction Company were checked and staff has
found them to be in good standing. Black Rock Construction has successfully completed other
City projects including most recently the rehabilitation of Alley No. 47 (between Cleveland
Avenue and Coolidge Avenue and from Baker Street to Paularino Avenue), Alley No. 116 (east
of Newport Boulevard from 23rd Street to Wilson Street), the northerly portion of Alley No. 75
(west of Fullerton Avenue and south of Flower Street), and Alley No. 76 (south of Flower Street
from Alley No. 75 to Fullerton Avenue).
ALTERNATIVES CONSIDERED:
The alternative to this Council action would be to reject all the bids. If all the bids are rejected, the
City would need to readvertise or cancel the project. Staff believes that readvertising the project
will not result in lower bids.
FISCAL REVIEW:
Funding for this project has been budgeted from Gas Tax revenues.
LEGAL REVIEW:
Black Rock Construction Company has furnished the necessary bonds and insurance, which were
approved as to form by the City Attorney. After the award and subsequent execution of the
contract, a "Notice to Proceed" will be issued.

CONCLUSION:
The advertisement and bid opening for the Parkway Concrete Repair and New Sidewalk
Construction Project, City Project No. 12-04, has been completed. It is recommended that the
City Council adopt the plans, specifications, and working details for said project; award the
contract to the apparent low bidder, Black Rock Construction, in the amount of $2,121,684.00
(base bid plus all additive bid items); and authorize the Mayor and the City Clerk to execute the
Public Works Agreement.
