SUBJECT: AUTHORIZATION OF REFUND FOR A MIXED-USE PROJECT AT 440 FAIR DRIVE

RECOMMENDATION:
Authorize refund in the amount of $12,111.60 to D'Alessio Investments Inc. for a project
that has been withdrawn.
BACKGROUND:
The project submitted in 2008 involved a proposal for a nine -unit, mixed-use
development on an existing parking lot located at 440 Fair Drive. The project included
several applications such as a General Plan Amendment, a Rezone and a Design
Review. The project also required preparation of an environmental analysis; therefore,
city staff initiated a Professional Services Agreement (PSA) with a consultant (Hogle-
Ireland) for preparation of a mitigated negative declaration in the amount of $15,700.00.
The project was withdrawn due to inactivity after a year and the PSA was cancelled.
ANALYSIS:
The requested refund is due to inactivity of the project. The fee in the amount of
$12,111.60 may be refunded to the applicant pursuant to the Council Policy 100-1. This
fee represents the applicant's deposit and does not involve City funds. ,
FISCAL REVIEW:
Fiscal review is not required for this item.
LEGAL REVIEW:
Legal review is not required.
CONCLUSION:
Pursuant to Council Policy 100-1, staff is recommending that Council authorize a refund
for the application and consultant fees related to a mixed-use project proposed at 440
Fair Drive.
