RECOMMENDED ACTION:
Adopt a Resolution authorizing the Public Services Director to execute all Project Specific
Program Supplements to the Administering Agency - State Agreement No. 00144S for State
Funded Projects (Attachment 1).
BACKGROUND:
Subsequent to State legislation allowing the use of certain State funds for use on local
transportation facilities, the California Department of Transportation (Caltrans) has established
a Master Agreement setting forth the requirements of local agencies in the administration of
projects receiving State -aid Program funds and the maintenance of the facilities completed with
these funds.
The City of Costa Mesa and the California Department of Transportation have been operating
under the Master Agreement No. 00144S for State Funded Projects. This Master Agreement
was executed in September 5, 2008.
ANALYSIS:
The Master Agreement No. 00144S sets forth the requirements for the City of Costa Mesa, as
the administering agency, and applies to all City projects financed entirely or in part with State
funds such as the State -Local Partnership Program (SLPP) and Safe Route To School (SRTS)
Program.
The Master Agreement requires the City to execute a project -specific Program Supplement to
the Master Agreement for each project receiving State funds. The Program Supplement is
required to secure the financial commitment of State administered State funds. The Resolution
(Attachment 1) will authorize the Public Services Director to execute the required Program
Supplements.
ALTERNATIVES CONSIDERED:
The City Council may elect to review each Program Supplement during regular Council meetings
and authorize the Mayor to sign the Project Specific Supplemental Agreements. This alternative
will delay the process of implementing projects for which staff is able to capture State funds. It
should be noted that currently, per Resolution No. 07-1 (Attachment 2), the Public Services
Director is authorized to sign Program Supplement Agreements for Federally funded projects.
FISCAL REVIEW:
There is no fiscal impact for this item.
LEGAL REVIEW:
The City Attorney's office has approved the attached Resolution as to form.
CONCLUSION:
The City of Costa Mesa and the California Department of Transportation (Caltrans) have been
operating under the Master Agreement No. 00144S for State Funded Projects. The Master
Agreement (executed in September 5, 2008) requires that a Supplemental Agreement be
executed specifically for each individual project which staff is successful in capturing State grant
funds. In order to expedite the process of implementing projects receiving State grant funds,
staff recommends that the City Council adopt a Resolution authorizing the Public Services
Director to execute project specific Supplemental Agreements.
