HomeMy WebLinkAbout51 - PH-1 - Attachment 2 - 6/17/2014RESOLUTION NO. 14- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA APPROVING GENERAL PLAN AMENDMENT GP -14-02, SUBJECT TO APPROVAL OF THE FINAL GENERAL PLAN CYCLE RESOLUTION, MODIFYING THE LAND USE DESIGNATION OF THE 14 -ACRE COUNTY ISLAND COMMONLY KNOWN AS THE SANTA ANA/COLLEEN ANNEXATION AREA FROM MDR (MEDIUM DENSITY RESIDENTIAL) TO LDR (LOW DENSITY RESIDENTIAL). THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, the Unincorporated Islands Program codified in Government Code Section 56375.3 streamlines the procedural requirements to encourage annexation of small unincorporated county islands within adjacent cities; and WHEREAS, a goal of the City of Costa Mesa 2000 General Plan, adopted by the City Council in January 2002, is to encourage annexation of county islands to the City that are within its sphere of influence; and WHEREAS, the General Plan is a long-range, comprehensive document that serves as a guide for the orderly development of the City of Costa Mesa subject to update and revision to account for current and future community needs; and WHEREAS, the City has filed an application with the Local Agency Formation Commission to annex approximately 14 acres of unincorporated territory referred to as the Santa Ana/Colleen Island to the City; and WHEREAS, the proposed annexation of the Santa Ana/Colleen Islands to the City requires a General Plan Designation of the property; and WHEREAS, the General Plan Designation of Low Density Residential (LDR) is most consistent with the surrounding area; and WHEREAS, the General Plan Designation of Low Density Residential (LDR) to the Santa Ana/Colleen Islands requires a General Plan Amendment GP -14-02 changing the land use designation of the 14 -acre site from MDR (Medium Density Residential) to LDR (Low Density Residential); and WHEREAS, General Plan Amendment GP -14-02 also requires an amendment to the Land Use Map of the City of Costa Mesa (Exhibit A); and WHEREAS, approval of the project is pending adoption of Ordinance No. 14 - for Rezone R-14-02 and adoption of the General Plan Cycle Resolution; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on May 12, 2014, with all persons having the opportunity to speak and be heard for and against the proposal; and WHEREAS, pursuant to the California Environmental Quality Act (CEQA), the Planning Commission determined that the project is exempt from further review under Section 15319(a) Annexation of Existing Facilities and Lots for Exempt Facilities; and WHEREAS, the Planning Commission, on a 5-0 vote, recommended that City Council find the project exempt from further CEQA review under Section 15319(a), approve General Plan Amendment GP -14-02, and Rezone R-14-02; and WHEREAS, a duly noticed public hearing was held by the City Council on June 17, 2014, with all persons having the opportunity to speak and be heard for and against the proposal; and BE IT RESOLVED that, based on the evidence in the record, THE CITY COUNCIL HEREBY ADOPTS GP -14-02 and amends the Land Use Map of the City of Costa Mesa (Exhibit A) subject to adoption of the Final General Plan Cycle Resolution and Rezone R- 14-02. BE IT FURTHER RESOLVED THAT the General Plan Amendment GP -14-02 and amendment to the Land Use Map is categorically exempt pursuant to Section 15319(a) of the California Environmental Quality Act -Annexation of Existing Facilities and Lots for Exempt Facilities.
