HomeMy WebLinkAbout80-76 - Declaring Election Results of June 3, 1980, Low-Rent HousingRESOLUTION NO. 80-76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING THE RESULTS OF THE LOW -RENT HOUSING MEASURE WHICH WAS CON- SOLIDATED WITH THE COUNTY OF ORANGE PRIMARY ELECTION ON JUNE 33, 1980. The City Council of the City of Costa Mesa Does Hereby Resolve as Follows: SECTION 1. That the City Council of the City of Costa Mesa does hereby find, determine, and declare as follows: (a) That Resolution 80-34 was adopted on March 17, 1980, request- ing to participate in the special election called by the Board of Supervisors of the County of Orange to approve rental hous- ing developments for elderly, handicapped, low or moderate income persons; and (b) That said election was held in consolidation with the Primary Election conducted by the County of Orange on June 3, 1980, for the purpose of voting upon Measure J, to wit: Shall rental housing developments, as contemplated by Article 34 of the California Constitution, for elderly, handicapped, low or moderate income persons be developed, constructed, financed or acquired in the unincorporated area of the County of Orange and in participating cities, subject to the follow- ing conditions: No county or city general fund monies shall be expended for such housing. No project shall be authorized by authority of this measure in the unincorporated area of the county unless notice of any such proposed project is first submitted to each member of the Board of Supervisors for approval and, at the same time, notice is given to the public. Notice to the public shall be legal notice in the newspaper having the greatest circulation within the affected area where the property is located and by posting the property in at least three (3) conspicuous places. Notice shall be submitted to each member of the Board and to the public before any funding application to a non -County entity is made for project approval or funding. After sub- mittal to the Board members, any Board member shall have thirty (30) days to place the matter on the Board agenda for the purpose of initiating a public hearing on the proposed project. If the matter is so placed, the project shall not be deemed approved until the Board, after such public hearing, approves, or conditionally approves, the project. If no ac- tion is taken by a member of the Board during the thirty (30) day period, the application, including the project ap- plied for, shall be considered approved. Any project proposed to be located in incorporated areas of the County shall be submitted to the appropriate City Coun- cil members for action, in the same manner as hereinabove described. Housing built or rehabilitated pursuant to this measure shall not exceed 5% of the total dwelling units within the unincorporated area of the County of Orange or, for partici- pating cities, within the city. A city is a participating city if the city council adopted a resolution requesting participation in this measure and sub- mitted it to the Registrar of Voters on or before March 21, 1980. (c) That the County of Orange conducted a canvass of the results of the number of votes cast for and against said measure as appears in the Certified Abstract of Statement of the vote entered in the Records of the Board of Super- visors of the County of Orange, to wit: "Measure J" Low -Rent Housing Yes: 119632 No: 7,214 Total votes cast: 23,498 SECTION 2. That the Certificate of Registrar of Voters and Results of the Canvass of the Primary Election Returns is attached hereto, marked Exhibit "A" and by this reference made a part hereof. SECTION 3. That the City Council does hereby accept the Certificate of the Registrar of Voters and declares that "Measure J" did pass by a majority vote. SECTION 4. That the City Clerk of this City is hereby directed to enter this resolution in the minutes of this City Council. SECTION 5. That the City Clerk shall certify the adoption of this resolution.
