HomeMy WebLinkAbout88-57 - Calling General Municipal Election for 11-8-88� /"� f 'Q 4• 11 a RESOLUTION NO. 88-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 8, 1988, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AND FOR DECISION BY THE VOTERS ON AN INITIATIVE MEASURE. WHEREAS, under the provisions of the laws relating to General Law Cities in the State of California, a regular General Municipal Election shall be held on November 8, 1988, for the election of three (3) Members of the City Council of said City for the full term of four (4) years; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALI- FORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities within said State, there shall be, and there is hereby called and ordered, held in the City of Costa Mesa, California, on Tuesday, November 8, 1988, a regular General Municipal Election of the qualified electors of said City for the purpose of electing three (3) Members of the City Council of said City for the full term of four (4) years. SECTION 2. That the following measure is to appear on the ballot: Measure G INITIATIVE ORDINANCE AND AMENDMENT TO GENERAL PLAN: GROWTH, FACILITIES AND SERVICE CONTROL. Shall the YES Initiative Measure entitled: "Citizens' Sensible Growth and Traffic Control Initiative" be adopted which would require certain levels of road and flood NO control facilities and certain levels of police, fire, and paramedic services in order to permit certain types of development projects? SECTION 3. That notwithstanding Section 2 above, the measure shall be removed fran the ballot for the November 8, 1988, election if the legal counsel for the California Secretary of State gives the City a legal opinion that because of defects in the circulator's declaration on some sections of the Initiative Petition the Clerk has a duty to,reject those sections, pro- vided, however, if these defects are corrected in time for the election material to be printed for the Orange County Registrar of Voters, then the measure will remain on the ballot, and further provided, the City will comply with any court ruling concerning this matter. SECTION 4. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 5. That the City Clerk of said City is hereby authorized, instructed, and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and parte phernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 6. That the polls for said election shall be open at seven o'clock a.m. of the day of said election and shall remain open continuously from said time until eight o'clock p.m. of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 7. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 8. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed, and directed to give such further or additional notice of said election, in time, form, and manner as required by law. SECTION 9. That the City Clerk shall certify to the passage and adop- tion of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
