A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, DECLARING A
VACANCY IN THE OFFICE OF MEMBER OF THE CITY
COUNCIL AND TO APPOINT A COUNCIL MEMBER TO
FILL THE REMAINDER OF THE TERM OF OFFICE
WHICH EXPIRES IN DECEMBER, 2012.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, Council Member Katrina Foley was the winner for an elected seat
on the Newport Mesa Unified School District Board, and her official resignation as
Council Member became effective December 31, 2010; and
WHEREAS, California Government Code Section 36512 provides that City
Council has the authority, within thirty (30) days from the commencement of the
vacancy to fill the vacancy by appointment or to call a special election to do so ; and
WHEREAS, the City Council finds that it is in the best interests of the City of
Costa Mesa to fill the vacancy for the un -expired term of the former incumbent by
appointing a successor; and
WHEREAS, the City Council has requested letters of interest from interested
residents that are qualified registered voters of the City, for consideration of
appointment to fill the unexpired term; and
WHEREAS, the City Council established the date of Friday, December 17, 2010
as the deadline for submission of said letters of interest, and by said deadline received
8 letters of interest and have reviewed the qualified applicants; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Costa Mesa does hereby resolve and declare as follows:
SECTION 1. That the City Council does hereby appoint Stephen Mensinger, an
elector and registered voter of the City of Costa Mesa, to fill the vacancy of Council
Member on the City Council of the City of Costa Mesa for the remainder of the present
term of the former incumbent Katrina Ann Foley whose four-year term expires in
December 2012.
